Back Guide on ‘right to liberty and security’ - available in Albanian

The Guide on Article 5 of the European Convention on Human Rights covering the right to liberty and security, is now available in Albanian, broadening access to essential legal principles for legal professionals across the country.

The Guide provides a comprehensive overview of the key principles developed by the European Court of Human Rights concerning the right to liberty and security, including the lawful grounds for deprivation of liberty, due process requirements, and procedural safeguards for persons deprived of their liberty. It outlines the conditions under which an individual can be deprived of liberty, the necessity for prompt judicial oversight, and the right to challenge the legality of detention. The guide also explains the distinctions between different types of detention and underscores the importance of protecting individual freedoms against arbitrary state interference.

As an important resource for Albanian legal professionals, the Guide will help them in implementing fair detention procedures and safeguarding individual liberties, in line with European standards. It offers practical and accessible tools that aim to enhance legal certainty, support the understanding and application of Article 5, and promote more informed judicial decisions, ultimately contributing to strengthening the rule of law in Albania.

The project "Strengthening the capacities of the Albanian judiciary to better apply standards on the right to liberty and security" is funded by the Human Rights Trust Fund (HRTF), which brings together eight Council of Europe member states: Finland, Germany, Ireland, Luxembourg, Netherlands, Norway, Switzerland, United Kingdom.
