Back Grand Chamber judgment Armani Da Silva v. the United Kingdom

On 30 March 2016, the Grand Chamber of the European Court of Human Rights delivered its judgment in the case of Armani Da Silva v. the United Kingdom, which concerned the death of Jean Charles de Menezes, who was shot by the police in the London Underground in July 2005, after being mistakenly identified as a person suspected of terrorist acts. The applicant, the cousin of Mr de Menezes, complained about the authorities’ refusal to bring a prosecution in relation to her cousin’s death.

Having regard to the proceedings as a whole, the Court found that the UK authorities had not failed in their obligations under Article 2 of the Convention to conduct an effective investigation into the shooting of Mr de Menezes which was capable of identifying and – if appropriate – punishing those responsible. The Court held that there had been no violation of the Convention.
