Επιστροφή Albania: Removal of disproportionate burden on owners of previously nationalised dwellings

In September, the Committee of Ministers ended its supervision of the execution of the case of Kasmi v. Albania, which concerns the inability of a flat owner to recover possession of his flat for many years as it was occupied by tenants who were protected by legal framework in the context of restitution of nationalised property, with a low amount of rent fixed by law.

The authorities addressed the problem underlying the above judgment through a broad legislative reform of 2012, setting clear deadlines and procedures for tenants to vacate restituted properties, and offered alternative housing solutions to the tenants, such as zero-interest loans and social rental housing, specifically targeting vulnerable groups. Since the beginning of the implementation of the relevant legislation and up to May 2026, the National Housing Agency facilitated implementation, processing over 1,020 eviction orders and notifications, while municipalities supported low-cost housing programs for tenants. Remedies for owners have been strengthened after 2016, allowing constitutional complaints for property violations.
