Rule of law Checklist at national level: case of Ukraine

This publication is a comprehensive detailed tool for the practical assessment of the rule of law. This instrument is based on the Rule of Law Checklist adopted by the Venice Commission at the 106th Plenary Session (Venice, 11-12 March 2016).

The implementation of international standards in the national legal system is carried out primarily at the legislative level. That is why this publication is aimed primarily at the legislative process and the practice of rulemaking. Accordingly, the main target audience is specialists who are involved in the Verkhovna Rada of Ukraine and abroad in the development of draft regulations, their expert elaboration, adoption and implementation.

This tool will also be useful for representatives of the judicial system, primarily judges of the Constitutional Court of Ukraine and courts of general jurisdiction. After all, the assessment of the rule of law should not be carried out in the form of external control, but it should be a continuous process of daily application of legal provisions with awareness of the essence and content of the rule of law and its components.
