The Register of Damage for Ukraine has opened the possibility of submitting claims for compensation in new categories relating to public expenditures incurred by the State of Ukraine as the result of the aggression of the Russian Federation against Ukraine:
B4 Humanitarian Public Expenditures to Support the Affected Population.
B5 Demining and Clearance of Unexploded Ordnance.
The opening of these categories allows the State of Ukraine to seek compensation for documented expenditures incurred to support the affected population and to restore the safety of territories contaminated by mines and unexploded ordnance, and to build the evidentiary basis required for this purpose.
Who Can Submit a Claim
Claims in categories B4 and B5 can be submitted by the State of Ukraine, including its central, regional and local authorities and entities.
What Expenditures Can Be Claimed
Category B4 covers humanitarian public expenditures to support the population affected by the Russian Federation's aggression, including expenditures related to the evacuation of individuals, temporary housing and collective sites, urgent medical treatment, rehabilitation programmes, and other expenses directly related to alleviating the consequences of the aggression for natural persons. Such expenditures may include, in particular, compensation for damaged or destroyed housing under the «eVidnovlennia» (eRecovery) programme.
Category B5 covers the costs of demining and clearance of unexploded ordnance in the territory of Ukraine, including demining activities, the hiring of demining experts, surveying and mapping of territories, the disposal and destruction of explosive ordnance, training of local personnel in demining techniques and safety measures, and informing and educating the public about the dangers of mines and unexploded ordnance.
Claims in both categories can be submitted only for expenditures financed from the State Budget of Ukraine or the budgets of regional and local authorities.
Claims relating to expenditures incurred for the benefit of individuals directly injured by mines and unexploded ordnance should be submitted in category B4. Claims by legal entities for their own demining or humanitarian expenditures should be submitted in other relevant categories, which will be opened shortly.
Claims that meet the established requirements will be recorded in the Register. They will subsequently be referred for examination to the future International Claims Commission, which will determine the amount of compensation due.
The Convention establishing this Commission under the auspices of the Council of Europe has already been signed by 39 States and the European Union.
How to Submit Claims
Claims are submitted via the Diia web portal. On behalf of an authority or entity, this may be done by its head (such as a director or chairperson). The head may also appoint a representative authorised to submit claims on behalf of the legal entity by granting that representative digital powers via Diia. Any legally capable individual may act as a representative.
