European integration and the uniformity of case law. The main challenges for Ukraine

Ensuring the uniformity of case law in Ukraine and the main challenges on this path were the key issues discussed at the dialogue platform "Uniformity of Case Law: An Attempt to Rethink" held in Lviv on 13 and 14 December.

Uniformity of case law is one of the requirements of Ukraine's European integration, and it is also one of the key principles of justice, ensuring predictability of decisions, stability of the legal framework and public trust in the judiciary.

The event was attended by judges of the Supreme Court, the European Court of Human Rights, courts of first instance and appellate courts, academics, attorneys, international experts, legal practitioners and students.

The participants discussed the uniformity of case law as a non-legal value and a European integration requirement, as well as the state of affairs regarding the Supreme Court's deviations from previously formed positions.

In addition, they presented tools to ensure the unity of the Supreme Court's case law and expressed their position on the unity of the Supreme Court's practice.

Representatives of the judiciary presented several possible options for amending legislation that would contribute to strengthening the uniformity of case law, including arguments "for" and "against".

They also outlined the state of affairs with ensuring the uniformity of case law in Ukraine and the Council of Europe standards in this context.


The event was organised by the Supreme Court in cooperation with the Ukrainian Catholic University, the Council of Europe project “Support to the functioning of justice in the war and post-war context in Ukraine”, and the OSCE Support Programme for Ukraine Project “Assisting Supreme Court and Higher Courts in Implementing Judicial Reform and War-related Justice”
