Committee of Ministers adopts Recommendation to fight impunity for crimes committed by terrorist groups in a conflict-related context

The Committee of Ministers adopted today a Recommendation on prosecuting terrorist offences, serious violations of international humanitarian law and other core international crimes committed in the context of a non‑international armed conflict. The Recommendation provides guidance to member States on how to navigate the complex interplay between international humanitarian law and counter-terrorism legislation.

Drawing on valuable experience acquired by some member States, the new Recommendation promotes and facilitates cumulative prosecutions to ensure accountability for the totality of the wrongdoing in which terrorist suspects may have engaged in the conflict and secure justice for victims of terrorism and of core international crimes. It also assists State authorities in identifying effective investigation means and addresses jurisdiction and statute of limitations questions to prevent impunity caused by legal loopholes.
