Back Second two-day online training on legal reasoning and legal drafting in civil cases

Second two-day online training on legal reasoning and legal drafting in civil cases with the consideration of the European Human Rights Court’s (ECtHR) case law and decisions of the Constitutional Court of Bosnia and Herzegovina is organised on 22 and 23 June 2020. The webinar has been designed to address the needs of judges and judicial assistants who, in the process of domestic adjudication, are required to refer to the case law of the ECtHR.

Since the coherence of judicial practice and therefore legal certainty is conditioned by the capacity of  judges to interpret the legal provisions in the light of the decisions of the higher courts, this training focuses and gives extensive overview of the case law of the Constitutional Court and the European Court of Human Rights. Additionally, the training explores the obligations of domestic courts concerning the extent and content of the reasoning they provide when deciding domestic cases, considering Article 6.1 of the European Convention of Human Rights - Right to a Fair Trial.   

The training is led by an experienced judge-trainer and a certified trainer, who completed the Training of Trainers course held in 2019 within the project.

This activity is organised in cooperation with the Judicial and Prosecutorial Training Centres of Republika Srpska and Federation of Bosnia and Herzegovina.

The training is organised under the project: “Initiative for Legal Certainty and Efficient Judiciary in Bosnia and Herzegovina” funded by the Kingdom of Norway.
