Back Paternity cases of children born out of wedlock lead to major reforms in Finland

Gronmark v. Finland

The Council of Europe Committee of Ministers ended in September 2018 the supervision of execution of four cases against Finland (Gronmark group).

These cases originated in violations of the applicants' right to respect for private life due to court decisions from 2003 to 2005 applying an absolute limitation period preventing children born out of wedlock before 1976 from bringing paternity claims.

In addition to the compensation that the government paid to the applicants, legislative changes, notably the 2016 Paternity Act, now give the possibility to all persons concerned to bring claims for the establishment of paternity, even if a court had previously decided not to establish paternity on the basis of the old legislation.
