Back Council of Europe review of the legal framework on verification and confiscation of unjustified assets

The recommendations to align the draft Law on Verification and Confiscation of Unjustified Assets with the international standards and comparative good practices were presented at the working meeting between the representatives of the Ministry of Justice and Council of Europe. The meeting was held on 18 October 2021 within the framework of the CoE/EU joint Project against Economic Crime in Kosovo* (PECK III) which undertook the review of the recent draft law initiated by the Ministry of Justice. The legal initiative aims at introducing a non-conviction-based confiscation mechanism for unjustified assets that are acquired through illicit enrichment.

The meeting was also an occasion for participants to further discuss with the Council of Europe on the model of the law, responsible implementing institution and challenges for international cooperation as well as reverse burden of proof, discrepancy of assets and threshold including the retroactivity in illicit enrichment.

The Council of Europe through the PECK III Project will further support the authorities in processing this legal initiative.
