In focus: Protecting the rights of the child and their best interests in situations of parental separation and in care proceedings

The Council of Europe Committee of Experts on the Rights and the Best Interests of the Child in Parental Separation and in Care Proceedings (CJ/ENF-ISE) will hold its first meeting online on 24 and 25 September 2020, with Mr Seamus S. Carroll (Ireland) in the Chair.

This committee constitutes a unique and transversal exercise at the Council of Europe level. It gathers 10 member states representatives, designated jointly by the European Committee on Legal Co-operation (CDCJ) and the Steering Committee for the Rights of the Child (CDENF), as well as other international and civil society organisations.

This first meeting of the Committee of Experts will kick off the work on reviewing the law, policy and practice in member states on:

  • The protection of the best interests of the child and their rights in situations of parental separation; and
  • The protection of the best interests of the child in domestic proceedings to limit parental responsibilities or place a child in care.

The CJ/ENF-ISE will also discuss the scope and nature of possible legal instruments and/or practical tools which could be developed to give guidance to Council of Europe member states and other stakeholders in these areas. Such preparation will be supported by consultations with relevant stakeholders, including children.
