Mission to Sarajevo focused on discrimination in elections

A mission to Sarajevo was carried out by the Execution Department from 23 to 26 April, focusing mainly on discrimination in elections in Bosnia and Herzegovina and aiming at preparing the Committee of Ministers’ examination of this issue at its June Human Rights’ meeting. The Committee has invited to this meeting a competent minister for an exchange of views on the strategy to ensure the implementation of these judgments in light notably of its finding that the absence of progress in adopting, since 2009, necessary constitutional reforms represents a violation of Article 46 of the Convention.

The delegation of the Execution Department had extensive exchanges at the highest level, including with the member of Presidency of Bosnia and Herzegovina H.E. Šefik Džaferović, both collegiums of the Parliamentary Assembly of Bosnia and Herzegovina together with the Speaker of the House of Peoples H.E. Bakir Izetbegović, President of the Constitutional Court of Bosnia and Herzegovina H.E. Zlatko Knežević, Minister of Justice of Bosnia and Herzegovina dr Josip Grubeša, members of the Central Electoral Commission as well as with other stakeholders and civil society. The delegation also met with the competent authorities of the Federation of Bosnia and Herzegovina and its cantons to assess progress made in the adoption of the measures required to remedy a long standing problem in a number of cantons of non-enforcement of domestic judicial decisions ordering the payment salary arrears, a major concern from the rule of law perspective, highlighting important problems of state administration.

An exchange was also carried out with the competent authorities from both Entities to discuss ongoing reforms to prevent compulsory placement of persons in social care homes without consent and decision of a competent court. This part of the mission was made possible thanks to the Horizontal Facility for the Western Balkans and Turkey, the EU and Council of Europe joint program.
