The first module of an e-course on electoral dispute resolution has been developed and launched by Council of Europe, in cooperation with the Central Electoral Commission of the Republic of Moldova, the National Institute of Justice and the Centre for Continuous Electoral Training of the Republic of Moldova.
This first module is based on the European Court of Human Rights (ECtHR) case law on electoral dispute resolution, and is designed to help the Moldovan judges, and dedicated electoral officials, to better understand and apply the European Convention on Human Rights while settling electoral complaints and disputes. The e-course also provides a broad description, through the ECtHR case law, of the principles of interpretation of the right to free elections (Article 3 Protocol No. 1), the situations in which Article 3 of Protocol No. 1 does not apply, as well as the restrictions on the right to vote and stand for election.
This e-course was developed following reports by international and domestic election observers underlining the need to improve electoral dispute resolution, as well as, following the requests, expressed directly by Moldovan judges, during the seminars on Electoral Dispute Resolution organized by the Council of Europe on the eve of the 2020 Presidential and 2021 earlier Parliamentary elections, to receive additional support in this field.
The electronic course is hosted by the National Institute of Justice’s e-platform and will be functional as from 15.12.2022.
