Decision adopted by the European Committee of Social rights at its 319th session

The European Committee of Social Rights adopted during its 319th session (22-26 March 2021):

The complaint was registered on 28 May 2020. The Greek Bar Associations (GBAs) alleged that the Greek authorities, through the social support given to lawyers during the Covid-19 pandemic, deprived them of their right to protection against poverty and social exclusion (Article 30), to the protection of their health (Article 11), to social security, to social assistance and to benefit from social welfare services (Article 13), to social, legal, and economic protection for their families (Article 16), to social, legal, and economic protection for their children (Article 17), and their right to housing (Article 31). Furthermore, the GBAs considered that the Government has excluded lawyers practising in Greece from social protection or has provided them with inferior and inadequate social protection compared to that offered to all other affected professional groups. The GBAs considered that this difference in treatment amounted to discrimination in breach of Article E of the Charter.

The Committee, by 13 votes against 1, declared the complaint inadmissible on 23 March 2021 and unanimously decided that it was not necessary to rule on the request for immediate measures.
