Protection of migrants, asylum-seekers and refugees while in administrative/immigration detention in Romania

On 26 September 2019 in Bucharest, the Council of Europe organised, together with UNHCR, a seminar entitled “ECtHR mechanisms to protect migrants, asylum-seekers and refugees while in administrative/immigration detention - Overview of the current migration and asylum context in Romania– main challenges in law and in practice”. Attorneys representing clients before domestic courts, as well as lawyers working with civil society organizations took part in the seminar where selected ECtHR case law under Art. 3 ECHR (prohibition of torture and ill-treatment) protection against expulsion, extradition and refoulement was presented, including ECtHR’s case law pertaining to applicants raising national security concerns. In addition, effective alternatives to immigration detention were debated, the protection against unlawful and/or arbitrary detention, as well as the right to judicial review of detention. Specific Council of Europe standards regarding the administrative detention of migrants and alternatives with a special focus on children and families were also highlighted.
