Back Capacity building of lawyers to effectively apply national remedies for the protection of the right to trial within a reasonable time

The Action has contributed greatly to enhancing capacities of legal professionals to effectively apply and invoke the relevant European Court of Human Rights case-law at the national level, with specific focus on the protection of the right to trial within a reasonable time.

A comprehensive capacity building programme for legal practitioners has been developed following recommendations put forward in an analysis produced within the Action. Among the key findings, the Analysis reported that the national legal remedies have not been used sufficiently, and the percentage of submitted remedies is by 10% lower than the number of backlog cases.

In the given context, the Action has started training lawyers on the application of Article 6(1) of the European Convention on Human Rights. The first training session was organised on 28 and 29 November 2018 in Budva, Montenegro. The training programme provided participants with the understanding of how legal proceedings at the national level must be conducted to be in concert with the obligations under the Convention.

The activity was organised within the framework of the Council of Europe Action entitled “Fighting ill-treatment and impunity and enhancing the application of the European Court of Human Rights case-law on the national level”, which is being implemented in Montenegro under the joint Council of Europe and the European Union programme “Horizontal Facility for Western Balkans and Turkey”.
