Back Presentation of the Needs assessment report in respect to the execution of the European Court of Human Rights judgments in relation to Serbia

The presentation of the Needs assessment report in respect to the execution of the European Court of Human Rights (the Court) judgments in relation to Serbia took place on 30 October in Belgrade.

This report took stock of the current situation regarding the execution of the Court judgments in Serbia with an emphasis placed on the status of the Government Agent of the Republic of Serbia before the Court, as defined in law and developed in practice, and how such status impacted on the effectiveness of the execution in general. The analysis also examined at the role of other institutions in the execution process and provided recommendations for enhancing the process of the execution of judgments in Serbia and strengthening the role of relevant national institutions in the process.

The event brought together around 30 representatives of the Constitutional Court, Supreme Court of Cassation, Republic public prosecutor’s office, National Assembly of the Republic of Serbia, Judicial Academy and Ombudsperson who discussed the main findings provided in the Needs Assessment and supported importance of the report. Further, they highlighted the necessity for further improvement of the process of the execution of the judgments of the European Court of Human Rights in Serbia and welcomed proposed recommendations in that respect. 

Solutions offered will be further addressed in the follow-up consultations with the national authorities which will take place in the following months.

 The presentation, as well as the development of the needs assessment, were organised within the Action “Strengthening the effective legal remedies to human rights violations in Serbia”, implemented under the European Union and Council of Europe Joint Programme “Horizontal Facility for the Western Balkans and Turkey 2019-2022”.
