Back The European Union and the Council of Europe continue series of training seminars on reopening of cases on the basis of judgment/decision of the European Court of Human Rights

On 23-24 June 2018, the training seminars were organized in Tbilisi for two groups of City and Appellate Court judges of criminal and civil chambers on “Reopening of cases on the basis of judgment/Decision of the European Court of Human Rights” in partnership with High School of Justice (HSoJ).

The activities aimed at familiarizing Georgian judges to the procedure of reopening of cases under the Recommendation No. R(2000)2 of the Committee of Ministers to member states on the re-examination or reopening of certain cases at domestic level following judgments of the European Court of Human Rights (the Court). The mentioned recommendation invites Georgia to ensure that its legal system contains the necessary legal remedies to achieve, as far as possible, principle of restitutio in integrum, and, in particular, provide adequate possibilities for re-examining cases, including reopening proceedings so that the damaged parties of the case should be put in the same situation as enjoyed prior to the violation of the Convention. Apart of that participants discussed a role of national courts in the process of a full, effective and prompt execution of the Court's judgments, and overviewed the state of execution of judgments in respect of Georgia.

As a result of the seminars 27 judges became better aware of legal aspects of reopening the cases at national level following the judgments of the Court.

Seminars were held by Mr. Pavlo Pushkar, the Council of Europe staff member, Head of Division of the Department for the Execution of the Court's Judgments.

Two day events were organized in the framework of the EU/Council of Europe Joint Project “Strengthening the Application of the European Convention on Human Rights in Georgia”, within the EU-Council of Europe Partnership for Good Governance.
