Back Strengthening the application of human rights standards in work of the Constitutional court of Montenegro

A working meeting on human rights standards in the area of property rights in the work of the Constitutional Court of Montenegro took place on 28-29 October 2021.

This meeting was organised as part of the activities aimed at strengthening the capacities of Montenegro’s judiciary to apply relevant human rights standards in their daily work.

Analyses of Montenegrin courts’ case-law, such as the Assessment on impact of the decisions of the Constitutional Court on the work of the Supreme Court of Montenegro (2018), have shown inconsistencies and differing interpretation of human rights standards, specifically concerning protection of the right to peaceful enjoyment of the property, legitimate expectations of the parties, equality of arms and prohibition of discrimination.

With the aim to address these important topics in the work of Montenegrin judicial institutions, an analysis will be developed tackling the application of European human rights standards in the work of the Constitutional Court of Montenegro. In this context, a working meeting was organised that brought together the representatives of the Constitutional Court, Registry in the European Court of Human Rights, and international and national consultants, to discuss the recommendations on the application of the relevant standards at the national level.

The meeting was organised within the action "Improved procedural safeguards in judicial proceedings in Montenegro", which is a part of the joint European Union and Council of Europe programme “Horizontal Facility for the Western Balkans and Turkey 2019-2022”.
