Back State Advocate in Albania assisted in the process of harmonisation of domestic court legislation with international provisions

Harmonisation of court legislation and practice with the standards imposed by the European Court of Human Rights (the Court) is a fundamental precondition for ensuring legal certainty and the guaranteeing overall protection of human rights in the member states.

In this context, the EU and Council of Europe action “Supporting effective domestic remedies and facilitating the execution of judgments in Albania” is assisting Albanian authorities in the process of harmonising the national case-law with that of the Court, as well as supporting the consolidation of institutional capacities of the State Advocate Office to achieve its objectives.

To help this process, two lawyers from the State Advocate have been seconded for one month each to the Department for the Execution of Judgments of the European Court of Human Rights. They gained expertise will further enhance the capacities of the State Advocate to monitor the harmonisation of domestic legal regulations with the provisions of the European Convention on Human Rights and the Court case-law.

The support to State Advocate in the process of harmonising the national case-law with that of the Court through increasing expertise and knowledge on the matter, is taking place in the framework of the action “Supporting enforcement of the judicial decisions and facilitating the execution of ECtHR judgements in Albania” under “Horizontal Facility for the Western Balkans and Turkey II”, a co-operation initiative co-funded by the European Union and the Council of Europe and implemented by the Council of Europe.
