Back Round Table: Admissibility Criteria

On 9 July 2019, the second thematic round table for judges and legal advisors of the Constitutional Court was organised under the Project on “Improving the Protection of European Human Rights Standards by the Constitutional Court”. It was dedicated to the European human rights standards on admissibility criteria.

Two international experts with comprehensive experience with the European Court of Human Rights, national human rights institutions, academia and international human rights organizations facilitated peer-to-peer collaborative learning and exchange with project beneficiaries.

Participants discussed the admissibility criteria applied by the European Court, in particular in two dimensions: inadmissibility based on the jurisdiction (including ratione temporis, ratione loci and ratione personae), and inadmissibility based on the merits (with focus on manifestly ill-founded applications and importance of the balancing of rights against public interest). The workshop also provided room for examination of admissibility criteria in many concrete cases and application of different articles of the European Convention on Human Rights and Fundamental Freedoms. Other aspects touched upon were victim status, potential victims and actio popularis along with prevention of abuse of rights. Judges and legal advisors of the Constitutional Court had an opportunity to exchange with the international counterparts and discuss some cases of the Constitutional Court.

As a follow up, the Project will support the production of a video on admissibility to the Constitutional Court purposed for professional and general public in Kosovo*.

The Project “Improving the Protection of European Human Rights Standards by the Constitutional Court” is funded by Norwegian government and implemented by the Council of Europe.
