The safety of journalists is on the agenda during the training of judges

The project “EU and Council of Europe working together to support freedom of media in Ukraine” in cooperation with the National School of Judges of Ukraine (hereinafter NSJU) during the quarantine conducted 5 two-day online trainings "Criminal legal protection of professional activity of journalists”. 112 judges participated in such webinars.

The specialized course has been being developed over four months by six judges-trainers with the involvement of Lyudmila Opryshko, Council of Europe consultant, and in direct cooperation with the representatives of NSJU.

Oleksandr Ishchenko, Deputy Head of the NSJU Department, effectively coordinated the development and implementation of the course. The training course passed a three-day approbation, which was combined with the training of future trainers among judges from all over the country. Later, four two-day online trainings were held on the basis of Lviv, Dnipro, Chernivtsi and Odessa regional departments of NSJU.

The trainees had the opportunity to improve their knowledge and judicial skills in the field of protection of journalists' professional activities, including standards in the field of freedom of speech and practice of the ECtHR, also as a result of thematic discussion of sessions and a number of practical interactive exercises.

Natalia Shuklina, Vice-Rector of NSJU, Professor and Honored Lawyer of Ukraine, said: "The training was developed in a short time to implement paragraph 16 of the Recommendations of the Parliamentary hearings "Safety of journalists in Ukraine: status, problems and solutions", approved by the Resolution of Verkhovna Rada of Ukraine # 456-IX of 14 January 2020. This course is important for both judges and candidates for the position of judge".

Galyna Smirnova, Senior Project Officer of the “EU and Council of Europe working together to support freedom of media in Ukraine” said: “The situation regarding journalists’ safety in Ukraine requires the state to adopt special measures in response to repeated cases of aggression against journalists. Currently, the Council of Europe's online platform for the protection of journalism and the safety of journalists has registered numerous cases of violations of journalists' rights in Ukraine. In addition, new challenges for journalism during quarantine emerged. That is why it is important to provide training for judges on international standards of the safety of journalists. Such trainings, as well as other activities planned by the Project, aim to enhance the safety of media actors through protection guaranteed by legislation and an effective national rapid response mechanism to protect media actors”.

During the trainings, Pavlo Puskar, Head of Division of the Department for the Execution of Judgements of the European Court of Human Rights of the Council of Europe, presented the ECtHR's case law on the protection of journalists' professional rights along with conclusions and recommendations for Ukraine.

It is worth reminding that the recommendations of the Parliamentary hearing on safety of journalists adopted by the Verkhovna Rada of Ukraine recommended that the National School of Judges of Ukraine include in the mandatory training of judges a special course on protection of professional activity of journalists and other media actors, effective investigation of crimes committed against them.

The program of the developed trainings covers a wide range of issues related to the professional activity of journalists and its criminal law protection.

The project plans to continue conducting trainings for law enforcement officers on this topic, in particular, within a specially developed training course on journalists’ safety based on a common methodology with three educational institutions - the National School of Judges of Ukraine, the National Academy of Internal Affairs and the National Academy of Prosecutors.

The project “EU and Council of Europe working together to support freedom of media in Ukraine” aims to strengthen the role of the media, its freedom and security, as well as public service broadcasting as tools for reaching consensus in Ukrainian society.
