The Project supported a meeting of the sub-group on the issues of confirmation of civil status and agreements, and recognition of relevant legal facts

On 12 September 2017 at the office of the Council of Europe in Kyiv a regular meeting of the working sub-group on the issues of confirmation of civil status and agreements, and recognition of relevant legal facts (hereinafter – the sub-group) held with the support of the Project “Strengthening the Human Rights Protection of Internally Displaced Persons in Ukraine”.

The sub-group is coordinated by Ms Olena Sinchuk, the Head of the Division for Providing Access to Legal Aid of the Coordinating Center for Legal Aid Provisioning.

The sub-group is an integral part of the interdepartmental Working Group on Improving National Legislation on the Protection of the Human Rights of Internally Displaced Persons, which has been created by the order # 27 of the Minister for Temporarily Occupied Territories and Internally Displaced Persons of Ukraine in October 2016.

A number of proposals for the draft Law of Ukraine “On Amendments to Certain Legislative Acts of Ukraine on the Protection of the Rights of Internally Displaced Persons” was developed as a result of the sub-group members' activity.

The above-mentioned draft law suggests to improve the procedure of implementing notarial acts concerning the property of internally displaced persons, which remained on the non-government controlled area of Ukraine; to exempt IDPs from the payment of court fees for confirmation of civil status and agreements in case of birth, death, registration and dissolution of a marriage, change of person's surname, as well as in all the cases related to the violation of the rights of IDPs, as defined by the Law of Ukraine “On ensuring of rights and freedoms of internally displaced persons”.

The draft law has received a positive expert opinion from the Ministry of Justice of Ukraine with some comments. Responding to the comments, representatives of the sub-group processed out the relevant package of documents with the approval of the interested Ministries, and finally proposals will be forwarded for consideration by the Cabinet of Ministers of Ukraine.

The Council of Europe Project “Strengthening the Human Rights Protection of Internally Displaced Persons in Ukraine” will further support an activity of the Working Group on Improving National Legislation on the Protection of the Human Rights of Internally Displaced Persons, providing relevant expertise and technical assistance.
