Cabinet of Ministers Action Plan regarding certain areas of Donetsk and Luhansk oblasts temporarily outside the control of the government of Ukraine responds to Council of Europe recommendations

On 30 January 2017, Mr Vadym Chernysh, Minister of Ukraine on Temporarily Occupied Territories and Internally Displaced Persons, met with representatives of Embassies and international organizations. At the meeting, Minister Chernysh presented the Action Plan aimed at implementing some principles of state internal policy on certain areas of Donetsk and Lugansk regions outside the control of the government of Ukraine, approved by the Cabinet of Ministers of Ukraine Resolution № 8-p on January 11, 2017.

The Action Plan aims at the reintegration of citizens of Ukraine living on the non-government controlled areas, and their return to the Ukrainian constitutional order. This is to be achieved, inter alia, through the means of “people's diplomacy” and the creation of conditions for the fulfillment of their human rights on territory under the jurisdiction of Ukraine. Among the main objectives of the Action Plan are the following:  ensuring the rights and freedoms of citizens on the basis of European standards of social protection; increasing the quality of social services; improving the social protection of children and the social well-being of the family; implementing a language policy in line with the norms of national and international law; promoting access to education; promoting cultural development and ensuring the freedom of media; resuming dialogue between representatives of different social and ethnic groups, cultures and religions; and creating the conditions to form a tolerant society.

This approach corresponds, inter alia, to the Resolution of the Parliamentary Assembly of the Council of Europe 2133 (2016) on Legal remedies for human rights violations on the Ukrainian territories outside the control of the Ukrainian authorities. The Resolution calls on the Ukrainian authorities “to make easier, as far as is in their power, the daily life of the inhabitants of the territories outside of their control and of the displaced persons from these areas…”(Paragraph 17.3 of the Resolution).

The Minister underlined that “the Action Plan is an extremely important document which confirms the readiness of the state to develop links between civilian citizens of Ukraine ’from person to person‘, helping children to get education, facilitating conditions of crossing the contact line, improving social protection and access to medical, legal and psychological services on the areas near the contact line”.

Representatives of the international community in Ukraine expressed their support to the Action Plan developed by the Ministry, and emphasized the importance of its effective implementation.

The Council of Europe Project “Strengthening the Human Rights Protection of Internally Displaced Persons in Ukraine” participated in the meeting as well, as a sustainable partner of the Ministry. The Project is planning to support activities of the above-mentioned Action Plan, which are relevant to the main objectives of the Project within the Council of Europe Action Plan for Ukraine 2015-2017.

In particular, the Project  notes how the approaches and priorities of the Action Plan correspond to the recommendations of the baseline analysis “Enhancing the National Legal Framework in Ukraine for Protecting the Human Rights of IDPs” prepared by experts of the Council of Europe.

If successfully implemented, the Action Plan should promote durable solutions for internally displaced persons, a number of whom could eventually as a result be able to return voluntarily, in safety and dignity, to their homes or places of habitual residence.
