The European Commission for Democracy through Law - better known as the Venice Commission as it meets in Venice - is the Council of Europe's advisory body on constitutional matters.
The role of the Venice Commission is to provide legal advice to its member states and, in particular, to help states wishing to bring their legal and institutional structures into line with European standards and international experience in the fields of democracy, human rights and the rule of law.
The Commission works in three areas:
- democratic institutions and fundamental rights
- constitutional justice and ordinary justice
- elections, referendums and political parties.
The Commission shares the standards and best practices adopted within the countries of the Council of Europe beyond its borders notably in neighbouring countries.
WHY DO WE IMPLEMENT THE PROJECT IN UKRAINE?
In Ukraine, Venice Commission (the European Commission "For Democracy through Law") in the framework of the Council of Europe Office in Ukraine implements the project “Supporting constitutional and legal reforms in Ukraine (Phase 4)”. The project is a part of the Action Plan for Ukraine for 2023–2026 which is a joint initiative of the Council of Europe and the Ukrainian authorities. The Action Plan aims to support Ukraine in fulfilling its statutory and specific obligations as a Council of Europe member state and to contribute towards addressing fundamental issues of human rights and rule of law.
WHAT ARE THE PROJECT OBJECTIVES?
Supporting constitutional and legal reforms, constitutional justice and assisting the Verkhovna Rada in conducting reforms aimed at enhancing its efficiency
- To support constitutional reforms and constitutional justice. The proposed action aims at supporting the Ukrainian authorities in improving the national constitutional and legal framework in line with the Council of Europe standards.
- To support the reform of electoral legislation and practice as there is a need to change the existing electoral legislation (if possible, to adopt a unified Election Code), including the electoral system.
- To assist to the Verkhovna Rada in conducting reforms aimed at enhancing its efficiency (in co-operation with the PACE).
