Execution of ECtHR judgments in Khaylo group of cases: Council of Europe supports expert discussion on effectiveness of investigation into deaths in Ukraine

On 29 May 2023, the Council of Europe organised jointly with the Ministry of Justice of Ukraine and Prosecutors’ Training Centre of Ukraine expert discussion on the issues related to the effectiveness of investigation into deaths in Ukraine. In particular, the discussion focused on issues concerning effectiveness of investigation into deaths as a result of road accidents or perpetrated by private parties in line with the findings of the European Court of Human Rights in Khaylo group of cases against Ukraine pending execution. The event brought together representatives of the Ministry of Justice of Ukraine, the Office of the Prosecutor General, the State Bureau of Investigation, the National Police, the Supreme Court, and civil society.

The discussion included presentations by international experts of the Council of Europe, Jeremy McBride, barrister at Monckton Chambers and member of the Council of Europe Expert Advisory Group to the Office of the Prosecutor General, who made an overview of the positive obligations of the State Parties under Article 2 of the European Convention on Human Rights, and Razvan Horatiu Radu, prosecutor within the Prosecutor's Office attached to the High Court of Cassation and Justice of Romania, who shared the experience of Romania in executing judgments of the European Court of Human Rights in cases related to the effectiveness of investigation into deaths.

Government Agent of Ukraine, Margaryta Sokorenko, provided information related to the execution of judgments of the European Court of Human Rights on effectiveness of investigation into deaths by Ukraine, while Khrystyna Fedunyshyn, lawyer at the Department of Execution of Judgments of the European Court of Human Rights discussed this issue from the perspective of the Council of Europe. After the presentations of speakers, participants had a moderated discussion with the opportunity to exchange views.
