Council of Europe supported an international workshop on the legal consequences of determining a normative act unconstitutional

The Council of Europe Projects ‘’Internal Displacement in Ukraine: Building Solutions” (hereinafter – Project) and “Supporting constitutional and legal reforms, constitutional justice and assisting the Verkhovna Rada in concluding reforms aimed at enhancing its efficiency” in cooperation with other international partners which promote the implementation of the justice reform, supported the organization of high-level International Workshop ‘’The Legal Consequences of Determining a Normative Act Unconstitutional for Human Rights Protection  in Administrative Justice Process”. The event is organized by Administrative Cassation Court of the Supreme Court of Ukraine on 31 July in Kyiv.

The organizers had to adapt the format of the event to the circumstances, caused by COVID-19. The workshop which had been planned in March 2020, has been eventually held online last week.

The speakers at the event were the President and judges of the Administrative Cassation Court of the Supreme Court of Ukraine, the Deputy Chairman of the Constitutional Court of Ukraine, and international experts.

The discussion centered around the retroactive effect of the judgments of the Constitutional Court and the mechanism of reviewing of the judgments in exceptional circumstances (part 3, Chapter III, The Code of Administrative Procedure of Ukraine).

Moreover, with the support of the Project, Slavica Banic, former Judge of the Constitutional Court of Croatia, took part and deliberated on the issues of the protection of internally displaced persons.

As a result of the workshop a key notes publication is being prepared. It will be disseminated through the website of the Supreme Court. This bilingual publication will be also published by the Council of Europe Project ‘’Internal Displacement in Ukraine: Building Solutions”.

The Project ‘’Internal Displacement in Ukraine: Building Solutions” has a solid tradition of cooperation with the Supreme Court of Ukraine. Recently the publication of the bilingual version of the report "Supreme Court 2019: facts and figures" was supported.

The translation of the Report was provided by the Council of Europe Project “Supporting constitutional and legal reforms, constitutional justice and assisting the Verkhovna Rada in concluding reforms aimed at enhancing its efficiency”.

The Project ‘’Internal Displacement in Ukraine: Building Solutions” is finalizing the 3rd edition of the manual “National court practice on internal displacement: appying the Council of Europe standards”.

The 2nd edition published last year is still in high demand by legal professionals in Ukraine.
