Back Comparative analysis of judicial and non-judicial measures providing access to redress

The Federal Administration mandated the Swiss Centre of Expertise in Human Rights (CSDE) and the Swiss Institute of Comparative Law (ISDC) to develop a study on judicial and non-judicial measures in other States that facilitate access for victims of human rights violations caused by an enterprise abroad to remedies in the home state of the enterprise. The study was published in 2017.

On the basis of this study, the Federal Council examined the judicial and non-judicial measures it wishes to develop, in order to improve access to grievance mechanisms in Switzerland for human rights violations resulting from actions of an enterprise located abroad.

Following its analysis, the Federal Council decided to implement additional measures, in order to increase access to compensation in Switzerland for those who have suffered human rights violations from an enterprise located in another country by adopting the following measures:

  • increase the visibility of judicial and non-judicial mechanisms of access to remedy;
  • continue dialogue within multi-stakeholder initiatives;
  • in future multi-stakeholder initiatives, consider whether professional associations of judges and lawyers can be included in relevant consultations;
  • continue efforts already made to reduce the costs of accessing the courts and promoting class action opportunities.
