The Ecole Nationale de la Magistrature (ENM) hosted the launching of the EU-CoE ‘HELP in the 28’ course on “Data Protection and Privacy Rights” in Paris on 16 December 2017.
The course was launched for a mixed group of magistrates and lawyers, selected by the ENM, the Centre de formation de Justice Administrative and the Conseil National des Barreaux (CNB), respectively.
The session was opened by Benoît Chamouard, head of international department of the ENM who highlighted the good collaboration between the ENM and the Programme HELP.
Tatiana Termacic, Head of the Council of Europe (CoE)’s Human Rights National Implementation Division underlined the need for legal professionals to provide redress mechanisms to victims of data protection and privacy rights breaches. She also stressed the uniqueness of the course combining both the vast CoE and EU legislation and case law.
Sophie Kwasny, Head of the Data Protection Unit in the CoE, covered the International and European standards and the articulation between the CoE and EU frameworks, highlighting the role of the CoE Convention 108 and the excellent EU-CoE collaboration alongside law making process, be it the EU reform adopted in April 2016 or the ongoing modernisation of Convention 108.
The European Programme for Human Rights Education for Legal Professionals in the 28 European Union Member States (HELP in the 28) was presented to a very pro-active audience. Funded by the EU, HELP in the 28 is implemented by the Council of Europe using the HELP methodology.
One of the key reference materials used for the development of this course has been the Handbook on Data Protection prepared jointly by the EU Fundamental Rights Agency, the CoE and the Registry of the ECtHR. Some thematic areas covered are media, medical data, e-communication, modern technologies (i.e., GPS, CCTV, drones) and privacy at the workplace. The extensive case law of the European Court of Human Rights and the Court of Justice of the European Union is also included.
The course will be moderated online by the national tutor, Conseiller d’Etat and European law expert Jean-Luc Sauron, who stressed the need for 21st century legal professionals to be aware and apply the European legislation. Once the pilot phase ends, the course will be publicly available on line (in French and adapted to the French legal order). In the meantime, the English version is accessible at the 'HELP in the 28' website to any user who opens a HELP account.
