Now Available: Free online HELP course on the Right to Property

Property Rights are everywhere and it has become common place to see States interfere with these rights. However, not all interferences are a breach of the right to property, which is enshrined in Article 1 of Protocol No. 1 to the European Convention of Human Rights (ECHR) and which is as important as other ECHR articles. Interferences may be legitimate if they pursue the general or public interest; but should not be arbitrary. As a result it is important for legal professionals to become familiar with the case law of the European Court of Human Rights (ECtHR) regarding this matter.

We are now pleased to announce that the first course on the Right to Property has launched on the HELP E-learning platform and is available in English.

The course covers interactively the Right to Property as enshrined in Article 1 of Protocol No. 1 to the ECHR and the relevant case law of the European Court of Human Rights.

This course has seven modules:

  1. Introduction
  2. Legal framework and scope
  3. The three rules
  4. Permissible restrictions and proportionality
  5. Specific areas of interest
  6. Interaction between Article 1 of Protocol No. 1 and other ECHR Articles
  7. Compensation and restitution

The course was developed by HELP, the European Programme for Human Rights Education for Legal Professionals which supports the Council of Europe (CoE) member states in implementing the ECHR, the European Social Charter and other CoE conventions at the national level, and was funded by the Kingdom of Norway in the framework of the project “Reinforcing the capacities of the judiciary to apply European Human Rights Standards at the national level in Bosnia and Herzegovina”.

The course will first be piloted in Bosnia and Herzegovina with final results expected later this year. National Training Institutions or Bar Associations interested in developing national translations and adaptations of the course can contact the HELP Secretariat.
