Back Ukraine: reforms to align defamation-related law and judicial practice with ECHR judgment

Siryk v. Ukraine

In February 2021, the Committee of Ministers ended the supervision of the execution of the ECHR judgment in Siryk v. Ukraine. This case concerned a violation of the applicant's freedom of expression due to domestic courts’ decisions finding her liable for defamation following her reporting alleged irregularities in the conduct of public officials.

Following the ECHR judgment, the authorities adopted a number of measures, including reforms aimed at aligning domestic law with the Convention and the Court’s case-law. Domestic courts’ case-law has also evolved in a Convention-compliant manner. Capacity-building activities for judges related to defamation cases have been and continue to be organised in Ukraine. Reforms in this field are supported by Council of Europe technical co-operation projects, including the project “EU and Council of Europe working together to support freedom of media in Ukraine”.
