The European Social Charter in the Journal of the Spanish Ministry of Labour, Migration and Social Security

The issue No. 137 of the Journal the Spanish Ministry of Labour, Migrations and Social Security (Revista del Ministerio de Trabajo, Migraciones y Seguridad Social - Derecho Social Internacional y Comunitario), is dedicated to the European Social Charter.

In the editorial, Luis Enrique De La Villa Gil, Emeritus Professor of Labour Law and Social Security (Madrid Autonomous University), advances that the collection of papers is and will remain for years a reference in Spanish language on international social rights law and on the degree of compliance by Spain with the European Social Charter. In addition, Professor De La Villa Gil underlines the failure by Spain to accept the Collective Complaints procedure, which precludes case-specific decisions in respect of Spain, and to ratify the Revised Charter, which in his view tarnishes the country’s image in the Council of Europe. In the latter respect, it should be noted that Spain’s Council of Ministers adopted a decision on 1 February 2019 to submit the issue of ratification of the Revised Charter to Parliament. The procedure was suspended shortly afterwards due to the dissolution of Parliament and the convening of general elections.

The issue includes eleven valuable papers on the Social Charter, four of them of a general nature - by Professors Luis Jimena Quesada (former member and President of the European Committee of Social Rights), Guillermo García González, Carmen Salcedo Beltrán and Petros Stangos (member of the Committee) - and seven - by Professors Daría Terrádez Salom, Luis Teixeira Alves, Alberto Arufe Varela, José Luis Salido Banús, Jesús Martínez Girón, Jesús Barceló Fernández and Pepa Burriel Rodríguez-Diosdado - on specific provisions of the Charter.

The magazine is bilingual in English and Spanish.
