The obligation of confidentiality under the European Social Charter must be respected by organisations lodging complaints before the European Committee of Social Rights

The Secretariat of the European Social Charter as well as the Committee of Ministers’ Delegates would like to remind to organisations lodging complaints before the European Committee of Social Rights that they have to respect the obligation of confidentiality under Article 8§2 of the Additional Protocol to the European Social Charter Providing for a System of Collective Complaints from 1995 relating to the communication of the decisions of the European Committee of Social Rights.

Indeed, Article 8§2 implies not only that the European Committee of Social Rights’ report remains strictly confidential, but also that no public reference is made to the content of the Committee’s decision and conclusions until the Committee of Ministers of the Council of Europe adopts a resolution or no later than a 4-month embargo period (after the date of transmission to the Committee of Ministers).
