The Conference of the Parties to the Warsaw Convention holds Extraordinary Plenary Meeting

The Conference of the Parties (COP) to the Convention on Laundering, Search, Seizure and Confiscation of the Proceeds from Crime and on the Financing of Terrorism held its Extraordinary Plenary Meeting on 12 May 2021.

The Plenary strongly welcomed the developments at the Parliamentary Assembly of the Council of Europe (PACE), in particular the adoption of the PACE Resolution “Urgent need to strengthen financial intelligence units - Sharper tools needed to improve confiscation of illegal assets” and the related PACE Recommendation 2195 (2021). The COP will take steps to follow-up on this Recommendation with its member-states and the Financial Action Task Force (FATF).

The COP adopted the Thematic Monitoring Report on application of Article 3(4) on reversal of burden of proof in the confiscation proceedings and also approved a framework for cooperation with the Council of Europe Committee on Counterterrorism.

In order to streamline the interpretation of the Convention, the Plenary approved the Interpretative Note on Article 9(3) of the Convention (“Criminalisation of money laundering”) and amendments to the Interpretative Note to Article 3(4) (“Reversal of the burden of proof”). The Plenary also agreed further steps to review the measures taken by member-states on confiscation of virtual assets.
