EXPLANATORY NOTE

In its explanatory report to the Senate of the Republic, dated 4 July 1988, on the ratification of the Convention, the Italian Government had indicated that "at the time of deposit of the instrument of ratification, [the Government] shall make a declaration of interpretation of paragraph 2 (a) of the Annex on Privileges and Immunities, under which the said paragraph 2 (a) should not be interpreted as excluding any police or customs check of the luggage of the members of the Committee, provided the check is carried out in compliance with the rules on confidentiality set forth in Article 11 of the Convention.

Due to an omission, the declaration was not made to the Secretary General, depository of the treaty, upon deposit of the instrument of ratification on 29 December 1988.

The Government of Italy corrects today this clerical mistake by forwarding to the Secretary General the text of the above mentioned declaration, to take effect at the date of entry into force of the Convention in respect of Italy.

European Convention on the Punishment of Road Traffic Offences

In pursuance of the provisions of Article 32 and paragraph 1.a of Annex II the Italian Government declares that Italy accepts Section III of the Convention only in respect of pecuniary penalties (fines).

In pursuance of the provisions of Article 32 and paragraph 2 of Annex II, the Italian Government declares that, for constitutional reasons, Italy reserves the right, in its own legislation, to authorise the acceptance of such requests for proceedings only as are required to be transmitted by virtue of the various criteria embodied in the national legislation of the State of the offence, provided that they are objective.

The Italian Government further declares that Italy reserves the right to require, in its own legislation, that the transmission by Italy of requests for proceedings to other Contracting Parties must conform to the objective criteria specifically embodied in Italian legislation.

With reference to the United Kingdom's request for an extension of the scope of application of the European Convention on Mutual Assistance in Criminal Matters (ETS No. 30) and its Additional Protocol (ETS No. 99) to the Bailiwick of Jersey, I have the honour to inform you that Italy accepts the above-mentioned extension of the Convention and the Protocol.

Nevertheless, taking into account the very small number of Italian requests concerning the Bailiwick of Jersey and the bilateral treaties, Italy does not deem it necessary to consider a refund of expenses outside the scope of what is set out in Article 20.

With a view to completing the declaration made on 23 August 1961 when depositing the instrument of ratification of the European Convention on Mutual Assistance in Criminal Matters of 20 April 1959, the Italian Government declares that with reference to Article 24 of the Convention the following authorities shall be deemed judicial authorities in addition to those already mentioned in the above-mentioned declaration which in all other respects shall remain unaltered:

- the Constitutional Court,
- the Parliamentary Commission of Enquiry.

The Italian Government wishes to point out in this connection that the two above-mentioned authorities only acquired their full jurisdiction at a date subsequent to the deposit by Italy of the instrument ratifying the Convention.

The Constitutional Court in fact issued the necessary supplementary rules for the exercise of its jurisdiction in relation to prosecutions within the meaning of Article 134 of the Constitution in the regulations of 27.11.1962 published in Official Gazette No 320 of 15 December 1962.

The jurisdiction of the Parliamentary Commission of Enquiry was specified in Act No 20 of 25 January 1962 dealing with "Rules relating to proceedings and prosecutions".

European Convention on Extradition

In accordance with Article 28, paragraph 3, of the European Convention on Extradition, the Republic of Italy notifies the applicability of the European Union Council Framework Decision 2002/584/JHA of 13 June 2002, on the European arrest warrant and the surrender procedures between Member States of the European Union.

The Framework Decision has been implemented in Italy by the Law of 22 April 2005 No. 69 (“Provisions for the implementation of the Council Framework Decision 2002/584/JHA of 13 June 2002, on the European arrest warrant and the surrender procedures between Member States”, G.U. 29 April 2005 No. 98), which entered into force on 14 May 2005.

The provisions of the Agreement shall not apply to Act No. 153 of 30 April 1969 (modified and completed), which instituted a social pension in favour of persons without resources. It is a non-contributory benefit, subject to a means condition, the amount of which is determined in relation to income. The financing is entirely borne by the State.
