Declaration contained in a Note verbale from the Permanent Representation of the Netherlands, dated 10 June 2009, handed over to the Secretary General on 10 June 2009 - Or. Engl.

The Kingdom of the Netherlands notes that the Conference of the High Contracting Parties to the European Convention of Human Rights (hereafter: "the Convention"), meeting in the margins of the 119th Ministerial Session of the Committee of Ministers of the Council of Europe, held in Madrid on 12 May 2009, agreed by consensus that the provisions regarding the new single-judge formation and the new competence of the committees of three judges contained in Protocol No. 14 to the Convention are to be applied on a provisional basis with respect to those States that express their consent, according to the modalities set out in document CM(2009)71 rev2.

The Kingdom of the Netherlands considers that the above agreement fully satisfies the requirement of Article 25, paragraph 1(b), of the Vienna Convention on the Law of Treaties, concerning the provisional application of treaties that do not expressly provide for such application.

The Kingdom of the Netherlands ratified Protocol No. 14 to the Convention on 2 February 2006 with respect to all constituent parts of the Kingdom. The Kingdom of the Netherlands hereby expresses its consent to the application of the provisions of Protocol No. 14 referred to above, according to the modalities set out in document CM(2009)71 rev2. This expression of consent pertains to the Netherlands, the Netherlands Antilles and Aruba.
