At their 1357th meeting on 16 October, the Ministers Deputies adopted the following texts:
- A Recommendation on the development of the ombudsman institution: The 47 Member States should put in place independent and efficient ombudsman institutions with a firm legal basis and should protect them when needed, bearing in mind also the principles developed by the Venice Commission in a text adopted in March 2019. The implementation of the Recommendation will be examined in 5 years’ time.
- A Recommendation on the system of the European Convention on Human Rights in university education and professional training: The 47 member states will ensure that the necessary information is made available to university students and professionals, in particular judges and prosecutors, so that they are fully informed about the system of the European Convention on Human Rights, including the most relevant case-law of the European Court of Human Rights and the main developments concerning the execution of the Court’s judgments. The Council of Europe tools, HUDOC database and HELP courses should be widely used. The implementation of the Recommendation will be examined in 5 years’ time.
- A Recommendation on fostering a culture of ethics in the teaching profession: This recommendation aims to foster ethics, transparency and integrity in education through the drafting, implementation and review of codes of ethics for the teaching profession. The provisions of the Recommendation cover all levels of education, from pre-primary to higher education, including vocational education, as ethical principles should prevail throughout the whole education system. The Recommendation therefore makes no difference between the different strands of education or between public and private education institutions.
- Practical Guidelines on Alternatives to Immigration Detention: Fostering Effective Results: These guidelines contain the key principles and processes to implement alternatives to detention in the context of migration and can help put an end to the wide use of immigration detention as a response to the arrival of refugees, asylum seekers and migrants.
- A Guide to good and promising practices on the way of reconciling Freedom of Expression with other rights and freedoms, in particular in Culturally Diverse Societies: This practical text draws on the established standards, principles, approaches and recommendations from international, regional and national legal bodies, in particular the European Convention on Human Rights and the principles that can be derived from the case-law of the European Court of Human Rights (see appendix) relating to freedom of expression in particular in the context of culturally diverse societies.
In addition, the Deputies held exchanges of views with:
- Mr Linos-Alexandre Sicilianos, President of the European Court of Human Rights; and
- Mr Jean-Paul Lehners, Chair of the European Commission against Racism and Intolerance (ECRI).
