Overall objective

This Action aims to improve the day-to-day functioning and quality of the justice system in Kosovo*, by making available to the beneficiaries the methodology and tools of the CEPEJ. The application of this methodology and tools leads to an increased capacity of the responsible beneficiaries to assess the efficiency of the Kosovo* judicial system, ensuring that justice is delivered within a reasonable time and that it meets good quality standards.

This Action will address the courts, and also strengthen the knowledge of the beneficiaries on the tools and methodology of the CEPEJ.

Specific objectives

The first specific objective is to enhance the efficiency of the justice system in accordance with CEPEJ standards and tools on judicial statistics and time management with:

  • An in-depth and global assessment of the judicial system with recommendations for improvements;
  • Support to the capacity of the KJC and of courts to improve judicial time management, the collection and management of statistical data and enhance their efficiency in accordance with CEPEJ methodology and tools, in particular the SATURN Guidelines.

The second specific objective is to enhance the quality of the justice system, in accordance with CEPEJ quality standards and tools with:

  • Court Coaching Programmes in close cooperation with the KJC in individual courts in view of building the capacity of courts to deliver a better justice service in accordance with CEPEJ quality tools such as the Checklist for promoting the quality of justice and the courts and the Handbook on conducting users’ satisfaction surveys.

Impact of the Action ”Strengthening the Quality and Efficiency of Justice in Kosovo (KoSEJ)” on the future Strategy on the Rule of Law in Kosovo*

On 26 April 2019, the Ministry of Justice (MoJ) Working Group of Kosovo on the functioning of the judicial and prosecutorial system presented its Policy Paper to support the elaboration of the new MOJ’s Sector Strategy on the Rule of Law which take due account of recommendations made in the framework of the Project “Strengthening the Quality and Efficiency of Justice in Kosovo (KoSEJ)“. Several of the measures proposed refer to the European Commission for the Efficiency of Justice (CEPEJ) methodology and tools for the collection and analysis of judicial statistics to address the backlog in Kosovo courts. It stresses that collecting reliable statistics is an important precondition for sound improvement policies and measures (“what you cannot measure, you cannot improve”). The Working Group also recommends to provide meaningful analysis by monitoring issues that affect the overall efficiency of courts as defined by standards of CEPEJ indicators of court performance (clearance rate, age of the pending cases, length of the proceedings, case per judge indicator) as well as in particular periods of inactivity and postponed hearings. In light of these successful results of the KoSEJ Action in the MOJ Functional Review process, the CEPEJ will continue to provide assistance with the implementation of these key orientations in a second phase of the Action.

The KoSEJ Action “Strengthening the Quality and Efficiency of Justice in Kosovo”, which is part of the programme entitled "Horizontal Facility for the Western Balkans and Turkey", co-funded by the European Union and the Council of Europe and implemented by the Council of Europe.
