Presentation of Ms Florence Merloz, Chair of the Council of Europe Drafting Group on the place of the European Convention on Human Rights in the European and International Legal Order (DH-SYSC-II), during the 55th meeting of the CAHDI

Ms Florence Merloz, Chair of the Council of Europe Drafting Group on the place of the European Convention on Human Rights in the European and International Legal Order (DH-SYSC-II) and Deputy Director for Human Rights in the Directorate of Legal Affairs at the Ministry of Europe and Foreign Affairs (France), provided the CAHDI with an overview of the terms of reference, context of work and working methods of the Drafting Group DH-SYSC-II. In her presentation, Ms Merloz underlined that the Drafting Group DH-SYSC-II is preparing a draft report for the Committee of Ministers containing conclusions and possible proposals for action concerning the place of the European Convention on Human Rights in the European and International legal order as well as the related challenges. In particular she referred to the three identified themes examined in the context of the work the Drafting Group DH-SYSC-II, namely: the challenge of interaction between the Convention and other branches of international law, including international customary law; the challenge of interaction between the Convention and other international human rights instruments to which the Council of Europe member States are parties and the challenge of interaction between the Convention and the legal order of the EU and other regional organisations.
