University lecture delivered in Rize

On 31 October 2022, a university lecture was organised for the Recep Tayyip Erdoğan University Faculty of Law in Rize. This was the second lecture planned in the framework of the Project to support the Turkish Constitutional Court (TCC). The President, Vice-Presidents, members and rapporteur-judges of the Turkish Constitutional Court, the Governor of Rize, President of the University, members of the law faculty, and representatives of the Council of Europe attended the lecture.

The event started with welcome speeches by the President of the University, Prof. Dr. Yusuf YILMAZ and the Governor of Rize, Kemal ÇEBER. Following these speeches, the President of the Turkish Constitutional Court, Zühtü ARSLAN delivered a presentation on the Turkish Constitutional Court (TCC). He explained that the TCC has been acting as a supreme judicial body for 60 years, reviewing the constitutionality of laws. The TCC has also been reviewing individual applications for the last 10 years. He further elaborated that, thanks to a rights-based approach most notable in the past decade, the Court has taken very important decisions safeguarding constitutional rights and freedoms, such as the right to life, freedom of expression, right to a fair trial, freedom of association, right to respect for private life, right to property.

A panel session presented the individual application mechanism, objective and subjective effect of the Court’s judgments, subsidiarity principle, and admissibility criteria by giving concrete examples of important case-law. This session was moderated by the TCC Vice-President Hasan Tahsin GÖKCAN, members of the Turkish Constitutional Court, Yıldız SEFERİNOĞLU and Prof. Dr. Yusuf Şevki HAKYEMEZ

The event enjoyed a good level of participation with the presence of approximately 500 students of the law faculty. During this interactive lecture, students had the opportunity to ask questions to panellists. This lecture was organised as a part of 30 seminars planned in the framework of the Project. It was also covered by local and national media (see news item links below).

The Joint Project on “Supporting the Effective Implementation of Turkish Constitutional Court Judgments in the Field of Fundamental Rights” is co-funded by the European Union and the Council of Europe and implemented by the Council of Europe. The Turkish Constitutional Court is the end beneficiary of the Project.
