Implementation of the Law No. 6284 was Opened to Discussion in Kars

“Workshop on Improving the Implementation of Law No. 6284 on Protection of Family and Prevention of Violence against Women” took place on 16-18 March 2022 in Kars within the scope of the EU-CoE Project titled “Improving the Effectiveness of Family Courts: Better Protection of the Rights of Family Members”.

The 3-day workshop was held in Kars, the province of one of the pilot courthouses of the Project, with the participation of all relevant stakeholders.

Representatives from Court of Cassation, Ministry of Justice, Ministry of Family and Social Services, Turkish Justice Academy, Regional Courts of Appeal, Family Courts, Kars Prosecutor's Office, Women’s Rights Commission of the Union of Turkish Bar Association, General Directorate of Security, Kars Governorship, Kafkas University, Kars Provincial Directorate of Security, Kars Provincial Gendarmerie Command, Kars Provincial Directorate of Health, Kars Violence Prevention and Monitoring Centre, Sarıkamış District Governorship, Sarıkamış District Directorate of Security, Sarıkamış District Gendarmerie Command, Sarıkamış Municipality and Council of Europe’s national and international project consultants participated in the event and contributed to the in-depth discussions.

The first day of the workshop evaluated the current practices regarding the prevention of domestic violence and protection of victims of domestic violence were evaluated in line with the socioeconomic and cultural status of victims of domestic violence, and stakeholder views on the implementation of effective practices were sought. In this context, undertaking and implementing the preventive and protective measures stipulated by the Law No. 6284 on the Protection of the Family and the Prevention of Violence Against Women, increasing the quality of the information and support services provided by the referral mechanisms such as law enforcement, health institutions, municipalities, bar associations, civil society organisations and call lines, and need for improvement in the implementation of measures to ensure victim safety, provision of shelter, livelihood assistance, psychological and legal support were addressed.

On the second day, the development needs of inter-agency cooperation and coordination in domestic violence cases were opened to discussion. Solutions regarding ensuring effectiveness of the injunctions rendered by the family courts, their effects in divorce proceedings, improving legal aid and unification of the practices were discussed.

The last day of the workshop focused on the shortcomings regarding effectiveness of the investigations by the domestic violence bureaus of public prosecutors’ offices and solutions to the problems identified at the stages of complaint and investigation were investigated.

As a follow-up to the workshop, an “Assessment Report” with a set of concrete recommendations for improvement will be prepared.

The “Improving the Effectiveness of Family Courts: Better Protection of the Rights of Family Members” Project is co-funded by the European Union and the Council of Europe and implemented by the Council of Europe and Justice Academy of Turkey. The Project aims to ensure rule of law and fundamental rights in Turkey as fully in line with international and European standards and to improve the effectiveness of family courts in protecting the rights of women, children, and other family members.
