Transborder transfers - Challenges of international data transfer from the perspective of the Convention 108+ and GDPR

The Council of Europe’s Convention 108 on Data Protection celebrates its 40th anniversary on 28 January 2021, during Germany’s Presidency of the Council of Europe’s Committee of Ministers. The Convention 108 was the first binding international treaty on data protection and a model for many other data protection regulations. It was opened for signature on 28 January 1981, which is the reason that date is celebrated every year as European Data Protection Day.

To take current developments into account, in 2018 the signatories to the Convention agreed on an amending protocol to update the Convention 108. The updated version is known as the Convention 108+.
The issues and problems that were relevant already in 1981 have lost none of their relevance; international data transfers in particular are the focus of special attention today.

The European Union’s General Data Protection Regulation, in force since 25 May 2018, created a single regulatory framework for handling personal data throughout the entire European Economic Area. Both the Convention 108+ and the EU’s General Data Protection Regulation contain provisions on international data transfer.

To explore the challenges of international data transfer from the perspective of the General Data Protection Regulation and the Convention 108+, the Federal Ministry of the Interior, Building and Community and the Conference of the Independent Data Protection Authorities of the Federation and the Federal States of Germany would therefore like to invite you to the following online conference on 28 January 2021, from 13:00 to 16:30
