The Permanent Representation of the Republic of North Macedonia to the Council of Europe presents its compliments to the Secretary General of the Council of Europe and, with reference to its Note Verbale 35-01-155/2 dated 1 April 2020 related to the exercise of the right of derogation from obligations under the Convention for the Protection of Human Rights and Fundamental Freedoms and further to the Notes Verbales 35-01-200/1 dated 29 April 2020, 35-01-226/2 dated 22 Маy 2020, 35-01-241/2 dated 2 June 2020 and 35-01-272/2 dated 17 June 2020 has the honour to inform that the State of emergency in the entire territory of the Republic of North Macedonia, established by the President of the Republic of North Macedonia by Decision No.08-777/3 of 15 June 2020, published in the Official Gazette of the Republic of North Macedonia No.159 of 15 June 2020, has ceased to exist as of 24 June 2020.

Pursuant to Article 15 of the Convention on the Protection of Human Rights and Fundamental Freedoms, the Government of the Republic of North Macedonia therefore withdraws its derogations under Article 8 and Article 11 of the European Convention for the Protection of Human Rights and Fundamental Freedoms, Article 2 of the Protocol of Human Rights and Fundamental Freedoms and Article 2 of Protocol No. 4 to the Convention for the Protection of Human Rights and Fundamental Freedoms and declares that provisions of the Convention for the Protection of Human Rights and Fundamental Freedoms are fully implemented again.

The Permanent Representation of the Republic of North Macedonia to the Council of Europe presents its compliments to the Secretary General of the Council of Europe and pursuant to Article 15 of the Convention for the Protection of Human Rights and Fundamental Freedoms has the honour to inform that the Republic of North Macedonia shall exercise the right to derogation from its obligations under the Convention for the Protection of Human Rights and Fundamental Freedoms on the entire territory of North Macedonia.

The Permanent Representation of the Republic of North Macedonia to the Council of Europe has the further honour to inform that following the announcement of the World Health Organization of 11 March 2020 confirming the COVID-19 coronavirus pandemic, and taking into account the significant danger its spreading has posed to the public health, on 18 March 2020, the President of the Republic of North Macedonia has adopted a Decision to establish the existence of state of emergency on the entire territory of the Republic of North Macedonia. The state of emergency has been established for a period of 30 days with a view to preventing the spread and coping with the consequence of the COVID-19 coronavirus. The Decision No. 08-526/2 of 18 March 2020 was signed by the President of the Republic, in accordance with Article 125 of the Constitution of the Republic of North Macedonia, and was published in the Official Gazette of the Republic of North Macedonia No. 68, dated 18 March 2020 (annexed hereto). The Decision shall be submitted to the Assembly of the Republic of North Macedonia to be verified as soon as the Assembly is in position to meet. It must be born in mind that the Assembly of the Republic of North Macedonia had been dissolved prior to the coronavirus crisis, on 16 February 2020, for the purpose of convening early parliamentary elections on 12 April 2020. During the state of emergency, the Government of the Republic of North Macedonia, in accordance with the Constitution and relevant laws, adopts Decrees with the force of law. Before the expiration of the 30 days the Government is obliged to submit to the President a detailed report for the effects of the measures that had been taken and a reasoned proposal for the need of potentially extending the state of emergency for additional 30 days.

The Government has publicly announced that certain human rights and fundamental freedoms guaranteed under the Constitution may be temporarily suspended or restricted for the duration of state of emergency, but only to the extent required by such circumstances and as much as the measures adopted do not create any discrimination on the basis of race, sex, ethnic origin, language, religion, political or other conviction, social status, education and other personal circumstances.

Since the first case of COVID-19 was detected on the territory of the Republic of North Macedonia on 24 February 2020, the Government of the Republic of North Macedonia gradually has adopted a set of decisions, conclusions and has been taking concrete preventive measures to protect the public health.

The measures adopted by the Government of the Republic of North Macedonia, among others include: suspension of regular classroom instruction in primary, secondary and vocational schools and universities, to be replaced with distance home learning, restriction of public assemblies, cancelling all public events, meetings and gatherings, closing of museums, theatres and cinemas for visitors, cancellation of performances and conferences, suspension of international passenger air traffic, establishing special rules of isolation and state-organized quarantine for citizens entering the territory, ban on and special regime of movement in parts and on the entire territory of the country, as well as additional movement restrictions.

The application of these measures may influence the exercise of certain rights and freedoms under the Convention and in some instances give reason for the necessity to derogate from certain obligations of the Republic of North Macedonia under Article 8 and Article 11 of the European Convention for the Protection of Human Rights and Fundamental Freedoms, Article 2 of the Protocol to the Convention for the Protection of Human Rights and Fundamental Freedoms and Article 2 of Protocol No. 4 to the Convention for the Protection of Human Rights and Fundamental Freedoms. The measures adopted by the Government are proportionate and targeted, required by the exigencies of the situation and are not inconsistent with other obligations under international law.

The Permanent Representation of the Republic of North Macedonia to the Council of Europe attaches to this Note Verbale unofficial translation of the Decision No. 08-526/2, signed by the President of the Republic of North Macedonia by which the state of emergency was declared, as well as subsequent Decrees adopted by the Government of the Republic of North Macedonia in the period from 12 to 27 March 2020.

The Permanent Representation of the Republic of North Macedonia to the Council of Europe shall additionally inform the Secretary General of the Council of Europe about new relevant decrees adopted by the Government in relation to the emergency situation, and will notify the Secretary General of the Council of Europe when these measures will have ceased to apply and thus the provisions of the Convention for the Protection of Human Rights and Fundamental Freedoms will be fully implemented again.

DECISION TO ESTABLISH THE EXISTENCE OF STATE OF EMERGENCY

I
The existence of state of emergency in the territory of the Republic of North Macedonia for a period of 30 days in order to have protection from and coping with the consequence of the coronavirus COVID-19 spread is hereby established.

II
The Decision is made on basis of the explained Proposal No. 44-2329/1 of 18 March 2020 submitted by the Government of the Republic of North Macedonia to the Assembly of the Republic of North Macedonia, which establishes the existence of pandemic proclaimed by the World Health Organization relating to a new type of virus that has spread across all continents and in the territory of the Republic of North Macedonia, and on the Communication No. 09-1690/2 of 18 March 2020 sent by the President of the Assembly of the Republic of North Macedonia stating that the Assembly of the Republic of North Macedonia, in accordance with the Decision on Dissolving the Assembly of the Republic of North Macedonia (“Official Gazette of the Republic of North Macedonia” No. 43/20), is not in a position to call a session to consider the Proposal submitted by the Government of the Republic of North Macedonia.

Ill
The Decision shall be submitted to the Assembly of the Republic of North Macedonia to be verified as soon as the Assembly is in position to meet.

IV
During the period of state of emergency, the Government, in accordance with the Constitution and the law, shall make decrees with force of law.

V
This Decision shall enter into force on the day of its publication in the Official Gazette of the Republic of North Macedonia.

Pursuant to Article 58, paragraph (1) of the Law on the Protection of the Population against Infectious Diseases in State of Emergency (Official Gazette of the Republic of North Macedonia, No. 66/04,139/08, 99/09,149/14,150/15, and 37/16), the Government of the Republic of North Macedonia, at its session held on 12 March 2020, made the following

DECISION ON MEASURES TO PREVENT THE INTRODUCTION AND SPREAD OF CORONAVIRUS COVID-19

Article 1
Under this Decision, in order to prevent the introduction and spread, and the possibility to be infected by the coronavirus COVID-19, and for the purpose to provide protection of the health of the population in the territory of the Republic of North Macedonia, the following measures shall be ordered:

1.     Teaching-education process and conducting classes in all kindergartens, centres for early child development, day-care child centres, elementary and secondary schools shall be prohibited.
2.     Conducting classes in higher-education institutions and public scientific institutions shall be prohibited.
3.     Dormitories for pupils and university students, libraries, theatres, cinema halls, museums, and playrooms for children shall suspend their operation.
4.     Attending all extracurricular activities and other private activities that children conduct outside of classes (attending teaching-education activities, courses, additional classes, sports trainings, etc.) shall be prohibited.
5.     Holding of and gathering people at mass meetings, rallies and events outdoor and in closed space, any kind of public and private gatherings and meetings, as well as all cultural, informational, sports events, shows, and festivals, regardless of the scale and number of participants, in public buildings and other public spaces (cinema halls, theatres, museums, libraries, sports facilities, exercise rooms, and playrooms for children) shall be prohibited.
6.     All sports facilities, exercise rooms, sports halls where holding of any type of gatherings and events can take place, regardless of the scale and number of participants, shall be prohibited.
7.     Holding of any type of sports events and competitions attended by spectators (public) shall be prohibited.
8.     Use of any type of swimming pools in the territory of the Republic of North Macedonia shall be prohibited.
9.     Operation of catering facilities, cafeterias, bars, restaurants, clubs, casinos, sports betting shops shall be prohibited from 18:00 hours until 07:00 hours the next day, while they shall work with half of their capacity for guests, that is, the minimum required distance of at least one meter and half to two meters among persons attending these facilities shall be kept.
10.     All bodies of state administration, public enterprises established by the state, share-holding companies owned by the state, agencies, funds, bureaus, institutions, administrations and all other institutions shall be prohibited to hold events, make trips, hold meetings, conduct trainings, seminars, conferences and other type of gatherings and shall have to cancel them, whereas the aforementioned shall be pointed out to units of self-government in the Republic of North Macedonia, public enterprises and other legal entities established by local self-government, and whereas the aforementioned shall be recommended to the private sector.
11.     Use of annual vacations, paid and unpaid leaves for all employees in the healthcare sector shall be prohibited, while the state medical specialization and sub-specialization of all medical staff employed at the Skopje Medical Centre shall be suspended and they shall return to their jobs at their home medical institutions.
12.     Economic operators and manufacturers in the Republic of North Macedonia shall be prohibited to export medical equipment and medical supplies and materials required to handle the coronavirus COVID-19 outbreak, except for those items for which a special permit has been issued by the Ministry of Health.
13.     Conducting organized bus transportation (by bus, station wagon, minibus, etc.) to the countries of high risk according to the list of the World Health Organization, as well as from such countries to the Republic of North Macedonia, shall be prohibited.
14.     It shall be prohibited for foreign nationals from the countries of high risk according to the list of the World Health Organization as published on the website of the Ministry of Health on the link: zdravstvo.gov.mk/wp- content/uploads/2020/03/Spisok-na-zemjill.03.2020.pdf, (hereinafter: list of the World Health Organization) to enter the Republic of North Macedonia, except for those who shall submit a medical certificate issued by a competent body for having stayed in a quarantine.
15.     Should passengers from countries with high and medium risk according to the list of the World Health Organization appear at the border crossing points of the Republic of North Macedonia, they shall be obliged to place themselves in self-isolation.

Article 2
Measures mentioned in Article 1 of this Decision shall be implemented until 24 March 2020, except for Measure No. 7 that shall be implemented 30 days as of the day of entry into force of this Decision.
During the time interval mentioned in paragraph 1 of this Article, it shall be obligatory to respect also other measures, recommendations, and guidelines adopted by the Government of the Republic of North Macedonia, upon proposal by competent institutions of the state administration and other coordinative and expert bodies in context of prevention of the coronavirus COVID-19 spread.

Article 3
This Decision shall enter into force on the next day after the day of its publication in the Official Gazette of the Republic of North Macedonia.

DECISION TO AMEND THE DECISION ON MEASURES TO PREVENT THE INTRODUCTION AND SPREAD OF CORONAVIRUS COVID-19

Article 1
In the Decision on Measures to Prevent the Introduction and Spread of Coronavirus COVID-19 (Official Gazette of the Republic of North Macedonia, No. 62/20, and 63/20), Article 1, item 9, shall be amended, reading as follows:
“9. Operation of cafeterias, bars, clubs, casinos, and sports betting shops shall be prohibited.”

Article 2
After point 17, five new points 18,19, 20, 21, and 22 shall be added, which shall read as follows:
“18. All land border crossing-points in the Republic of North Macedonia shall be closed for passengers and vehicles, except for Tabanovce, Deve Bair, Kjafasan, Bogorodica, and Blace border crossing-points that shall be open for crossing. At the border crossing- points in the Republic of North Macedonia that are closed for passage of passengers and vehicles, only passage of freight vehicles shall be allowed.
19. Ohrid St. Paul the Apostle Airport and the border-crossing point at this airport shall be closed within 48 hours as of the day of entry into force of this Decision.
20. Entry into the territory of the Republic of North Macedonia by foreign nationals from countries with medium risk, according to the list of the World Health Organization, shall be prohibited, except for those foreign nationals for which the Ministry of the Interior shall grant permit upon prior opinion given by the Main Crisis Coordination HQ confirming that there exists special state or economic interest. Such foreign nationals shall enter the Republic of North Macedonia under special safety conditions in accordance with the protocol of the Ministry of Health.
21. All shops located in malls in the territory of the Republic of North Macedonia shall be closed for visitors, except for supermarkets, food shops, and pharmacies within such malls. All other shops - legal entities within such malls may operate and may conduct sale in an alternative manner (by online orders, telephone orders, etc.) and make delivery of such orders.
22. All catering facilities and restraints that prepare and sell food shall be closed. They may operate without visitors and guests visiting them inside and may conduct sale in an alternative manner (by online orders, telephone orders, etc.) or enable individual take of the orders by clients outside of the catering or restaurant premises (by use of a counter or stand)”.

DECISION TO AMEND THE DECISION ON MEASURES TO PREVENT THE INTRODUCTION AND SPREAD OF THE CORONAVIRUS COVID-19

Article 1
In the Decision on measures to prevent the introduction and spread of the coronavirus COVID-19 (Official Gazette of the Republic of North Macedonia, No. 62/20, 63/20, and 64/20), Article 1, point 18 shall be amended, which shall read as follows:
“18. All border crossing-points in the Republic of North Macedonia shall be closed for passing of foreign nationals - passengers and vehicles, except for entry and transit of freight vehicles, for representatives of the diplomatic corps in the Republic of North Macedonia, as well as for other persons for which the Ministry of the Interior shall grant permit upon prior opinion given by the Main Crisis Coordination HQ confirming that there exists special state or economic interest. Such freight vehicles and persons shall enter the Republic of North Macedonia under special safety conditions in accordance with the protocol of the Ministry of Health.”

After point 22, a new point 23 shall be added, which shall read as follows:
“23. Skopje International Airport and the border-crossing point at this airport shall be closed after expiration of 48 hours as of the day of entry into force of this Decision, except for state, military, humanitarian, medical-treatment and cargo flights as well as flights without passengers for aircraft positioning, with previous notice to airport operator TAV Macedonia DOOEL, while M-NAV AD-Skopje (Air Traffic Control) shall issue a corresponding NOTAM recommendation for this”.

This Decision shall enter into force on the day of its publication in the Official Gazette of the Republic of North Macedonia.

In pursuance with Article 58, paragraph (1) of the Law on the Protection of the Population against Infectious Diseases in State of Emergency (Official Gazette of the Republic of Macedonia, Nos. 66/04,139/08, 99/09,149/14,150/15, and 37/16), at its session held on 16 March 2020, the Government of the Republic of North Macedonia adopted the following

DECISION TO AMEND THE DECISION ON MEASURES TO PREVENT THE INTRODUCTION AND SPREAD OF CORONAVIRUS COVID-19

Article 1
In the Decision on Measures to Prevent the Introduction and Spread of Coronavirus COVID-19 (Official Gazette of the Republic of North Macedonia Nos. 62/20, 63/20, 64/20, and 66/20), three new items shall be added after item 23 in Article 1 as follows:

“24. Driving schools shall be hereby prohibited from delivering instruction and carrying out trainings and examinations in examination centres.
25. Persons and vehicles shall be prohibited access to Vodno Forest Park in all days and in a period from 18:00 hrs. to 6:00 hrs. the next day.
26. Gatherings in groups of more than five persons each across parks and other public spaces and areas shall be prohibited”.

Article 2
In Article 2, paragraph 1, the full stop at the end of the sentence shall be replaced with a comma, and the following words shall be added:
“as well as Measure No.24, to be in force for the duration of 14 days from the date of entry into force of this Decision”.

Article 3
This Decision shall enter into force on the day of its publication in the Official Gazette of the Republic of North Macedonia.

Article 1
The Law on Public Gatherings during State of Emergency (Official Gazette of the Republic of Macedonia Nos. 55/95, 19/06, 66/07, and 152/15; and Official Gazette of the Republic of North Macedonia No. 31/20) shall apply over the course of the state of emergency, unless otherwise regulated under this Decree with the Force of Law.
For the duration of the state of emergency, the provisions as set forth under this Decree with the Force of Law shall apply to carrying out public gatherings.

Article 2
For the duration of the state of emergency, carrying out public gatherings shall be prohibited across the entire territory of the Republic of North Macedonia.

Article 3
This Decree with the Force of Law shall enter into force on the day of its publication in the Official Gazette of the Republic of North Macedonia.

DECREE WITH THE FORCE OF LAW ON THE APPLICATION OF THE LAW ON THE PROTECTION OF THE POPULATION AGAINST INFECTIOUS DISEASES DURING STATE OF EMERGENCY

Article 1
The Law on the Protection of the Population against Infectious Diseases during State of Emergency (Official Gazette of the Republic of Macedonia Nos. 66/04, 139/08, 99/09, 149/14, 150/15, and 37/16) shall apply over the course of the state of emergency, unless otherwise regulated under this Decree with the Force of Law.
For the duration of the state of emergency, the provisions as set forth under this Decree with the Force of Law shall apply to the type of disease that is being transmitted from one human to another subject to the measure of strict isolation (quarantine) being applied; to the person subject to the measure of strict isolation (quarantine) being applied; to the issuing of the measure of strict isolation (quarantine); to the facilities used to enforce the measure of strict isolation (quarantine); and to the place and duration of the measure of strict isolation (quarantine) being applied.

Article 2
Persons suffering from the Coronavirus COVID-19 infectious disease shall be subject to the measure of strict isolation (quarantine), while undergoing home or medical treatment in a healthcare institution as determined by health workers upon conducting assessment of the degree of seriousness of the clinical status of persons suffering from the Coronavirus COVID-19 infectious disease.
Persons who have been or suspect to have been in direct contact with persons suffering from or infected by Coronavirus COVID-19 shall be subject to the measure of strict isolation (quarantine) at home (home isolation) to the duration of 14 days, for which the foregoing persons shall sign a written statement providing consent to adhere to the measure under full moral, material, and criminal responsibility, subject to a Decision to be issued by the State Sanitary and Health Inspectorate.
Persons provided for under paragraph 2 of this Article failing to adhere to the measure of Strict isolation (quarantine) at home (home isolation) shall be subject to the measure of strict isolation (quarantine) to the duration of 14 days in facilities as selected for that purpose by the Government of the Republic of North Macedonia, subject to a Decision to be issued by the Ministry of the Interior and the Army of the Republic of North Macedonia.
Nationals of the Republic of North Macedonia entering the Republic of North Macedonia at designated border crossings as provided for by law shall be subject to the measure of strict isolation (quarantine) to the duration of 14 days in facilities as provided for under paragraph 3 of this Article.

Article 3
Persons subject to the measure of strict isolation (quarantine) shall for the duration of the measure be prohibited from abandoning the premises they shall be accommodated in.
The security of the facilities as provided for under Article 2, paragraph 3 of this decree with the force of law, as well as the enforcement of the measure of strict isolation (quarantine), shall be ensured by the Ministry of the Interior and the Ministry of Defense - Army of the Republic of North Macedonia, which shall be securing the entrances of the foregoing facilities, while securing all stories of the facilities if multi-storied.
Officers of the Ministry of the Interior and the Ministry of Defense - Army of the Republic of North Macedonia securing the facilities as provided for under Article 2, paragraph 3 of this decree with the force of law which are subject to the measure of strict isolation (quarantine) shall be obligated to wear protective gear.
The Government of the Republic of North Macedonia shall publish a public call for expression of interest to all hotels on the territory of the Republic of North Macedonia registering accommodation capacities of more than 50 beds interested in voluntarily ceding their capacities for purposes of being used as state quarantine facilities for the population in the Republic of North Macedonia and offering a maximum of EUR 10 in MKD equivalent for covering relating food, accommodation, and hygiene expenses.
Contracts with hotels expressing interest as stipulated shall be concluded by the Government of the Republic of North Macedonia - Secretariat General of the Government of the Republic of North Macedonia, subject to contract negotiations without the announcement of a public call.
Food, accommodation, and hygiene-maintenance expenses in facilities in which the measure of quarantine is being carried out for persons entering border crossings of the Republic of North Macedonia shall be covered by funds from the Budget of the Government of the Republic of North Macedonia as provided for under budgetary item 425 - Contractual Services.
Food, accommodation, and hygiene-maintenance expenses in facilities in which the measure of quarantine is being carried out for persons having been found to be failing to adhere to the measure of strict isolation (quarantine) at home (home isolation) shall be covered by the foregoing persons themselves.
Expenses for transporting persons from border crossings of the Republic of North Macedonia and Skopje International Airport to state quarantine facilities shall be covered by the Government of the Republic of North Macedonia - Secretariat General of the Government of the Republic of North Macedonia, subject to contract negotiations without the announcement of a public call.

Article 4
For purposes of removing irregularities established, the Ministry of the Interior and the Ministry of Defense - Army of the Republic of North Macedonia may and shall be obligated to raise criminal charges against persons as provided for under Article 2 of this Decree with the Force of Law subject to the measure of strict isolation (quarantine) at home, in healthcare facilities, or in facilities as set out under Article 2, paragraph 3 of this Decree with the Force of Law, should such persons abandon quarantine prior to expiry of the quarantine period.
Persons provided for under paragraph 1 of this Article ordered to be placed in pre¬trial detention shall be placed in pre-trial detention in the facilities provided for under Article 2, paragraph 3 of this Decree with the Force of Law.

Article 5
This Decree with the Force of Law shall enter into force on the day of publication in the Official Gazette of the Republic of North Macedonia.

DECREE AMENDING AND SUPPLEMENTING THE DECREE WITH THE FORCE OF LAW ON THE APPLICATION OF THE LAW ON THE PROTECTION OF THE POPULATION AGAINST INFECTIOUS DISEASES IN A STATE OF EMERGENCY

Article 1
Following paragraph 3 of Article 3 of the Decree with the force of law on the application of the Law on the Protection of the Population against Infectious Diseases in a State of Emergency, a new paragraph 4 shall be inserted, which shall read as follows;
“persons referred to in paragraphs 2 and 4 of Article 2 of this Decree with the force of law may be placed under the measure of strict isolation (quarantine) to be implemented in hospitality facilities (hotels, motels and similar), which have been provided by privately owned legal entities performing hospitality economic activities, and which the Government of the Republic of North Macedonia has designated as facilities to be used for the implementation of the measures of strict isolation (quarantine).”
The word “hotels” in paragraph 4 shall be replaced with the following words “privately owned legal entities performing hospitality economic activities”.
The word “hotels” in paragraph 5 shall be replaced with the following words “privately owned legal entities performing hospitality economic activities".

Article 2
Nine new Articles 3-a,3-b,3-c,3-d,3-e, 3-f, 3-g, 3-h, 3-i and 3-j shall be added following Article 3 and they shall read as follows:

“Article 3-a
Facilities referred to in paragraph 3 of Article 2 and in paragraph 4 of Article 3 of this Decree with the force of law shall be secured by officers of the Ministry of the Interior and by troops of the Army of the Republic of North Macedonia, who shall be deployed at each floor of the concerned facility, as well as in front of the entry/exit of the facility.

Article 3-b
Prior to being placed in facilities referred to in paragraph 3 of Article 2 and in paragraph 4 of Article 3 of this Decree with the force of law, persons who have been placed under the measure of strict isolation (quarantine) shall sign a Statement, which has been enclosed and makes an integral part of this Decree.

Article 3-c
In facilities referred to in paragraph 3 of Article 2 and in paragraph 4 of Article 3 of this Decree with the force of law there shall be a special room designated for persons who show symptoms of the virus.

Article 3-d
In facilities referred to in paragraph 3 of Article 2 and in paragraph 4 of Article 3 of this Decree with the force of law there shall be a period defined for serving meals, stated on a menu from which the person who has been placed under the measure of strict isolation (quarantine) shall choose the type of food.

Article 3-e
Packages (parcels) may be delivered to facilities referred to in paragraph 3 of Article 2 and in paragraph 4 of Article 3 of this Decree with the force of law for the needs of persons who have been placed under the measure of strict isolation (quarantine), only during the day from 11:00 to 12:00 hrs., sent by persons outside the facility (relatives or friends).
Packages (parcels) may contain various items such as clothes, personal hygiene products, food, mail, and other necessary items.
Packages (parcels) must be cardboard boxes sealed with a wrapping plastic foil on all sides, while the name and surname of the person who has been placed under the measure of strict isolation (quarantine), as well as his/her room number and his/her telephone number must be clearly stated on the package.
Packages (parcels) shall be given to persons securing facilities referred to in paragraph 3 of Article 2 and in paragraph 4 of Article 3 of this Decree with the force of law, at the entrance of the facility and then the package shall be placed in front of the door of the room where the person who has been placed under the measure of strict isolation (quarantine) is accommodated.

Article 3-f
In facilities referred to in paragraph 3 of Article 2 and in paragraph 4 of Article 3 of this Decree with the force of law there shall be bedlinen provided for the needs of persons who have been placed under the measure of strict isolation (quarantine), which has been placed in an appropriate bag.
Every seventh day persons who have been placed under the measure of strict isolation (quarantine) shall be given new bedlinen, while the used bedlinen shall be placed in the same bag in which the previously used bedlinen has been provided.
Facilities referred to in paragraph 3 of Article 2 and in paragraph 4 of Article 3 of this Decree with the force of law shall be disinfected every fifth day. The procedure for engaging a legal person to perform the disinfection shall be implemented by the Secretariat General of the Government of the Republic of North Macedonia.

Article 3-g
The manager of the facilities referred to in paragraph 3 of Article 2 and in paragraph 4 of Article 3 of this Decree with the force of law may provide volunteers to perform auxiliary -technical activities related to the measure of the strict isolation (quarantine), such as delivery of food from the kitchen to the rooms and other necessary technical activities.

Article 3- h
Persons who have been placed under the measure of strict isolation (quarantine) shall be transported from border crossing points to facilities referred to in paragraph 3 of Article 2 and in paragraph 4 of Article 3 of this Decree with the force of law at least two times a day in the period from 10:00 hrs to 20:00 hrs., while persons coming at airports shall be transported to the said facilities immediately after landing.
The transportation of such persons shall be provided by the Secretariat General of the Government of the Republic of North Macedonia.

Article 3-i
Food required for officers of the Ministry of the Interior and the troops of the Army of the Republic of North Macedonia, who secure facilities referred to in paragraph 3 of Article 2 and in paragraph 4 of Article 3 of this Decree with the force of law shall be provided by the Secretariat General of the Government of the Republic of North Macedonia.

Article 3-j
Public utility companies and landfill companies shall be obliged to collect and deposit free of charge the waste from facilities referred to in paragraph 3 of Article 2 and in paragraph 4 of Article 3 of this Decree with the force of law.
Every public utility company shall designate persons, who shall collect the waste in the facilities.”

Article 3
This Decree with the force of law shall enter into force on the date of its publishing in the Official Gazette of the Republic of North Macedonia.

DECREE WITH THE FORCE OF LAW ON THE APPLICATION OF THE LAW ON PRIMARY EDUCATION IN STATE OF EMERGENCY

Article 1
The Law on Primary Education (Official Gazette of the Republic of North Macedonia No. 161/19) shall be applied for the entire duration of the state of emergency in the Republic of North Macedonia, unless otherwise provided for under this Decree with the force of law.
The organization and implementation of instruction in primary schools and the grading of pupils during the state of emergency shall be subject to the provisions of this Decree with the force of law.

Article 2
Instruction in primary schools shall be organized and carried out as distance learning, i.e. learning at home, using means for electronic communication.
Means for electronic communication within the meaning of this Decree shall cover means that ensure instruction without the communal physical presence of pupils in the teaching process (schools) and which provide for two-way communication.
Means of electronic communication may be video-conference platforms, e-mail communication or other systems for electronic exchange of data.
Schools shall decide which type of means for electronic communication referred to in paragraph 2 of this Article shall be used for this purpose.

Article 3
During the period in which the instruction is carried out by way of distance learning, i.e. learning at home, teachers may grade pupils.
Checks of the knowledge orally or by sitting for tests may be organized by applying means of electronic communication. Other forms of assessing the knowledge of pupils may be applied as well.

Article 4
This Decree with the force of law shall enter into force on the date of its publishing in the Official Gazette of the Republic of North Macedonia.

The Republic of Macedonia does hereby declare that in the period from January 1, 1998 to the day of entry into force of Protocol No. 11 to the Convention for the Protection of Human Rights and Fundamental Freedoms, restructuring the control machinery established thereby, on condition of reciprocity, it recognises as compulsory ipso facto the jurisdiction of the European Court of Human Rights, in accordance with Article 46 of the Convention for the Protection of Human Rights and Fundamental Freedoms [see Article 34 of the Convention since the entry into force of Protocol No. 11], to interpret and apply the Convention for the Protection of Human Rights and Fundamental Freedoms, Articles 1 to 4 of Protocol No. 4 and Articles 1 to 5 of Protocol No. 7, in cases where the violation of the rights guaranteed in these instruments occurred after these instruments came into force for the Republic of Macedonia.
