Zpět New practice of the Croatian Constitutional Court following ECHR judgment concerning costs incurred by vulnerable persons

In December 2022, the Constitutional Court aligned its practice with the European Court’s judgment in Dragan Kovačević concerning the Constitutional Court’s failure to reimburse the applicant, a person of low-income suffering from a mental disability, the costs incurred in the proceedings upon the constitutional complaint. In particular, when deciding on costs incurred in the proceedings before it, the Constitutional Court shall now provide meaningful reasons for its decision while being mindful of the specific circumstances of each case, including the significance the cases have for the complainants, their financial situation and whether they belong to vulnerable groups. The Constitutional Court requests the complainants to submit elaborations and documentation supporting their claims.
