Права мигрантов, беженцев и просителей убежища

Во всех частях Европы появились тревожные тенденции в обращении с просителями убежища и беженцами, а также с нелегальными мигрантами. Государства все сильнее и сильнее укрепляют охрану границ, стараясь не допустить въезда мигрантов на свою территорию. Мигрантов, включая просителей убежища, которым удается незаконно проникнуть на территорию государств — членов Совета Европы, часто объявляют преступниками, запирают в центрах, похожих на тюрьмы, и как можно скорее высылают, причем даже в те страны, где им грозят преследования и пытки. Однако нелегальная миграция — не уголовное преступление, и кроме того, в рамках международного права нелегальные мигранты имеют определенные права, которые нужно соблюдать.

Пытаясь не допустить злоупотребления ходатайствами о предоставлении убежища, государства нарушают права настоящих просителей убежища, которых часто помещают под стражу и лишают доступа к справедливой и эффективной процедуре рассмотрения заявлений.

Комиссар работает с государствами-членами и консультирует их, стремясь укрепить защиту прав мигрантов и обеспечить нелегальным мигрантам и их детям право на базовые услуги здравоохранения и образования. Он отстаивает их право на защиту от произвольных задержаний и от высылки в страны, где им грозят пытки и жестокое обращение.

Комиссар акцентирует внимание на том, что самой уязвимой группой в современной Европе являются дети мигрантов, которые часто лишены элементарной медицинской помощи и образования и рискуют стать объектом эксплуатации со стороны торговцев людьми и контрабандистов.
