Back Ukraine: Parliament adopts Recommendations concerning the execution of ECHR judgments

Ivanov / Burmych, Nevmerzhitsky / Sukachov, Zelenchuk and Tsytsyura v. Ukraine

On 17 February, following a hearing on “Problems of implementation by Ukraine of the ECHR judgments”, Parliament adopted two Recommendations concerning the execution by Ukraine of ECHR judgments and the reform of the system of execution of domestic judgments.1 The following three groups of ECHR judgments were identified as main priorities for execution: Ivanov / Burmych (non-enforcement of domestic judgments), Nevmerzhitsky / Sukachov (prisons’ overcrowding and inhuman and/or degrading conditions of detention) and Zelenchuk and Tsytsyura (moratorium on the alienation of agricultural land), these being cases raising the most complex, systemic and structural problems that need to be resolved by the authorities.

The recommendations related to the non-enforcement of domestic judgments (Ivanov/ Burmych) focus, among other things, on: the review of the current system of enforcement of judgments and their automatic execution, the review of the system of moratoriums affecting execution, and the establishment of effective domestic remedies. The recommendations related to prison conditions (Nevmerzhitsky / Sukachov) emphasised the need to improve the material conditions of detention in Ukraine and to introduce effective domestic remedies. Lastly, as regards the issue of moratorium on agricultural land alienation (Zelenchuk and Tsytsyura), Parliament recommended that the authorities ensure implementation of the newly adopted law in accordance with the principles of protection of property rights under the Convention and the European Court’s case-law.
