Registration of an appeal before the Administrative Tribunal

19.04.2018 - On 3 April 2018, the Administrative Tribunal registered appeal No. 589/2018 – Victor SOLOVEYTCHIK v. Secretary General. The appellant seeks the annulment of the decision of 20 December 2017 of the Directorate of Human Resources insofar as it determines that a pension transfer request submitted after a date fixed by HRD would be refused.

This information is given to enable those who so wish to exercise their right to intervene under Article 10 of the Statute of the Administrative Tribunal.

New composition of the Administrative Tribunal

29.03.2018 - On 21 March 2018, the Committee of Ministers of the Council of Europe appointed the judges and deputy judges of the Administrative Tribunal of the Council of Europe for a new term. Previously, the European Court of Human Rights had appointed the Chair and the Deputy Chair. For the term as from 1st April 2018, the Administrative Tribunal is composed as follows:

Registration of two appeals before the Administrative Tribunal

26.03.2018 - On 19 March 2018, the Administrative Tribunal registered two appeals (Nos. 587-588/2018 – Jannick DEVAUX (II) and (III) v. Secretary General). In the first appeal, the appellant challenges the refusal of maintaining her remuneration. In the second appeal, she challenges the decision to refuse the renewal of her contract.

This information is given to enable those who so wish to exercise their right to intervene under Article 10 of the Statute of the Administrative Tribunal.

Request for an opinion on jurisdictional immunity of international organisations and rights of their staff

20.02.2018 - During the 2018 First part-session, on 26 January 2018, the Parliamentary Assembly of the Council of Europe examined a report on Jurisdictional immunity of international organisations and rights of their staff. In this context, it adopted the Resolution No. 2206 and made the Recommendation No. 2122 (2018) to the Committee of Ministers of the Council of Europe.

On 7 February 2018, the Committee of Ministers agreed, inter alia, to communicate this Recommendation to the Administrative Tribunal for an opinion by 21 March 2018.

16.01.2018 - Two hearings were held before the Administrative Tribunal on Wednesday 24 January 2018 in the Tribunal’s hearing room in the D building in appeals below:

- 11 a.m.: No. 586/2017 – Manuel PAOLILLO v. Secretary General.

The first hearing was chaired by Mr Christos ROZAKIS, Chair of the Tribunal; the second hearing by Mr Giorgio Malinverni, Deputy Chair.

Extension of the jurisdiction of the Administrative Tribunal of the Council of Europe to the staff of the HCCH and OTIF

15.12.2017 - The Council of Europe signed two Agreements with the Hague Conference on Private International Law (HCCH) and the Intergovernmental Organisation for International Carriage by Rail (OTIF) to extend the jurisdiction of the Administrative Tribunal of the Council of Europe to these international organisations enjoying immunity. From now on, the Administrative Tribunal will be able to examine the related disputes between these organisations and their staff members. Both Agreements were signed by Ms. Gabriella Battaini-Dragoni, Deputy Secretary General of the Council of Europe, and, respectively, on 24 November 2017 by Mr. Christophe Bernasconi, Secretary General of HCCH, and on 8 December by Mr. François Davenne, Secretary General of OTIF.

The Agreements provide for an internal appeal procedure – prior to the referral to the Tribunal – which will apply to staff of both Organisations. It is a procedure specific to the international organisation concerned, which involves a conciliator during the procedure. The conciliator is appointed by the Chair of the Administrative Tribunal.

On 16 December 2014, the Administrative Tribunal had already signed a similar Agreement allowing the extension of its jurisdiction to the Central Commission for the Navigation of the Rhine (CCNR).

Publication of the Internal Justice Systems of International Organisations Legitimacy Index 2017 (Bretton Woods Law)

13.11.2017 - The Internal Justice Systems of International Organisations Legitimacy Index 2017 (Bretton Woods Law) was launched during the 5th International Administrative Law Centre of Excellence annual conference which was held in London on 26-27 October 2017.

The Council of Europe' scoring is published for the first time in this index. It is ranked in third position out of 33 Systems, after the Commonwealth Secretariat (COMSEC) and the United Nations (UN) (ex aequo).

25.10.2017 - On 18 September and 4 October 2017, the Administrative Tribunal registered two appeals (No. 585/2017 – Rona BROWN v. Secretary General and No. 586/2017 – Manuel PAOLILLO v. Secretary General). In the first appeal, the appellant challenges the amount of the providence invalidity benefits. In the second appeal, the appellant challenges the refusal of his demand for compensation for acts of moral harassment. Visit by the Geneva Registry of the United Nations Dispute Tribunal to the Administrative Tribunal of the Council of Europe

20.07.2017 - From 28 to 30 June 2017, the Administrative Tribunal of the Council of Europe was visited by a delegation from the Geneva Registry of the United Nations Dispute Tribunal.

During the visit, the delegation held exchanges with the judges and members of the Registry on the working methods and case law of the two tribunals. In addition, the delegation attended a hearing and met lawyers from the Directorate of Legal Advice and Public International Law (which is tasked with representing the Secretary General before the Tribunal), as well as the Chair of the Staff Committee; it also gathered information on the working methods of the European Court of Human Rights and its case law relating to international civil service.

The visit took place as part of the co-operation between international tribunals initiated by the Administrative Tribunal of the Council of Europe. Any other sister tribunal wishing to participate in an exchange visit between registries or any other body wishing to undertake a visit may contact the Registry of the Administrative Tribunal of the Council of Europe in order to agree arrangements for the visit.

Adjournment of a Hearing of the Administrative Tribunal

27.06.2017 - The public hearing in appeals Nos. 571-578/2017 - James BRANNAN and others v. Secretary General scheduled on 29 June 2017 has been adjourned for reasons of “force majeure”. The new date will be indicated later.

Registration of ten appeals before the Administrative Tribunal

07.04.2017 - From 6 to 30 March 2017, the Administrative Tribunal registered two series of appeals:

- In eight appeals (Nos. 571-578/2017 - James BRANNAN and others v. Secretary General), some appellants request the annulment of the provisions of Rules No. 1384 and No. 1385 and, all of them, the provisions of Rule No. 1387, modifying CEMSIS insurance medical coverage.

- Two appeals (Nos. 579-580/2017 - Zeki UYSAL and Sibel DEMİR SALDIRIM v. Secretary General) concern the appointment to posts of seconded lawyers at the European Court of Human Rights. They request that their competencies be recognised and they demand the annulment of the Secretary General’s decision to appoint the four successful candidates.

Proceedings of the international colloquy "Common focus and autonomy of International Administrative Tribunals" (Strasbourg, 19-20 March 2015)

06.04.2017 - On 19-20 March 2015 the Administrative Tribunal of the Council of Europe held a colloquy to celebrate its 50th anniversary. The tribunal wished to mark this anniversary by bringing together many members from other similar tribunals and practitioners in this field of law, in order to hold an exchange on the current situation in international administrative justice. Indeed, during the last 50 years the world of such tribunals has not only expanded, but also changed significantly.

20.05.2016 - On 11 March 2016, the Administrative Tribunal registered appeal No. 569/2016 – Natalia KRAVCHENKO (II) v. Secretary General. The appellant, a former temporary staff member, challenges the Secretary General’s decision to reject her request for protection and assistance in her action before the Directorate of Human Resources and in her judicial proceedings against the “Bas-Rhin sickness insurance fund (Caisse Primaire d’Assurance Maladie du Bas-Rhin)” about an invalidity pension following an accident at work reported by the Directorate of Human Resources. 27.06.2015 - Since May 2015, the Administrative Tribunal registered six appeals:

- No. 562-563-564/2015 - Gyorgyi KACSANDI (II) (III) (IV) v. Governor of the Council of Europe Development Bank concerning respectively the decision to terminate the appellant’s fixed term contract, a complain about psychological harassment and unequal treatment, as well as the decision to refuse the appellant a permanent contract at the end of her probationary period.

- No. 565/2015 - Maria-Lucia ORISTANIO (II) v. Governor of the Council of Europe Development Bank concerning the continuation of the deterioration of the appellant’s working conditions, downgrading, moral harassment and a disguised disciplinary measure against the appellant (see appeal No. 559/2014).

- No. 566/2015 - Holger SEIFERT v. Governor of the Council of Europe Development Bank concerning a new hierarchical junction resulting in a diminution of responsibilities, as well as a complain about moral harassment.

- No. 567/2015 - Costas SKOURAS v. Secretary General concerning the decision not to renew the appellant’s contract.

50 years of the Administrative Tribunal of the Council of Europe

19.03.2015 - To mark the 50th anniversary of its establishment, the Administrative Tribunal of the Council of Europe organised an international colloquy on 19-20 March 2015 at the Palais de l'Europe. 02.02.2015 - On 12 December 2014 and 15 January 2015, the Administrative Tribunal registered two appeals (No. 559/2014 – Maria-Lucia ORISTANIO v. Governor of the Council of Europe Development Bank and No. 560/2015 – Nataliya YAKIMOVA v. Secretary General). In the first appeal, the appellant is complaining of a deterioration of her working conditions, a downgrading, a moral harassment and a disguised disciplinary measure under the guise of a reorganization. She contests the refusal of her demand to be reestablished in the integrality of her duties. In the second appeal, the appellant is complaining about the Secretary General’s refusal to effect advancement in step after 24 months of service (article 3 of Appendix IV to the Staff Regulations). She also challenges the exclusion of probationary period from the term of service in the calculations for the purposes of advances of steps.

Extension of the jurisdiction of the Administrative Tribunal of the Council of Europe to the staff of the Central Commission for the Navigation of the Rhine (CCNR)

16.01.2015 - On 16 December 2014, the Council of Europe signed an Agreement with the Central Commission for the Navigation of the Rhine (CCNR) – an international organisation enjoying immunity – allowing the Administrative Tribunal of the Council of Europe to examine the related disputes between this organisation and its staff members.

This Agreement followed the amendment of Article 15 of the Statute of the Administrative Tribunal (Annex XI to the Staff Regulations), which has extended the jurisdiction of the Tribunal to cover disputes between international governmental organisations other than the Council of Europe and their respective officials. The internal appeal procedure – prior to the referral to the Tribunal which will apply to agents of the Commission – is a procedure specific to this international organisation which involves a conciliator during the procedure. The conciliator will be appointed by the Chair of the Administrative Tribunal, after reviewing all the applications submitted to the Registry of the Administrative Tribunal.

15.12.2014 - On 2 December 2014, the Administrative Tribunal registered appeal N° 558/2014 – Martine CARALY-STARKE v. Secretary General. The appellant asks that the accident she sustained should be regarded as an accident at work. 10.10.2014 - On 17 September 2014, the Administrative Tribunal registered two appeals (No. 555/2014 - Geneviève MAYER and 556/2014 - Fabrice KELLENS) challenging the recruitment procedure following vacancy notice No. e257/2013 as well as the subsequent decisions including the appointment of another candidate. On 19 September 2014, the Administrative Tribunal registered one appeal (No. 557/2014 - Gunilla HEDMAN) seeking for revision of Rule No. 1364 of 28 January 2014 on contributions towards collective insurance premiums. 26.08.2014 - On 14 August 2014, the Administrative Tribunal registered appeal No. 554/2014 – Viacheslav PETRASHENKO v. Secretary General. The appellant seeks the annulment of the Secretary General’s decision not to appoint him to a position of lawyer at the Registry of the European Court of Human Rights and not to put him on the reserve list further to an external recruitment competition. Extension of the jurisdiction of the Administrative Tribunal of the Council of Europe to other international governmental organisations

25.08.2014 - In its Resolution 2014(4) of 11 June 2014, the Committee of Ministers of the Council of Europe has amended Article 15 of the Statute of the Tribunal - Appendix XI to the Staff Regulations. By this change, the jurisdiction of the Administrative Tribunal has been extended to cover disputes between international governmental organisations other than the Council of Europe and their respective officials. Further information can be obtained from the Registry of the Administrative Tribunal. Discussions are ongoing between the Council of Europe and the Central Commission for the Navigation of the Rhine to allow it to recognize the jurisdiction of the Tribunal.

06.03.2014 - On 11 and 21 February 2014, the Administrative Tribunal registered two appeals (No. 543/2014 – Bilge KURT TORUN and No. 544/2014 – Carlo TANCREDI (II) v. Secretary General. On 13 May 2008 the Administrative Tribunal registered appeal N° 408/2008 – Natasha PACE ABU-GHOSH v. Secretary General.
