Indicative catalogue of criteria for delimiting borderline situations between cosmetic and medicinal products
INTRODUCTION
Borderline situations and borderline products are to a very great extent defined by claims and the form of advertising given for a product. This became evident during the discussion of the data-sheets for borderline products and is laid down in the preamble of the CoE-publication “Cosmetic Products – Borderline Situations” prepared by the Committee of Experts on Cosmetic Products.
The cosmetic as well as the pharmaceutical products regulations in the Member States of the Partial Agreement give definitions (Directive 76/768/EC for cosmetics and the Directive 65/65/EC for pharmaceutical products). The classification of a product depends on the fulfilment of these definitions with regard to composition, application, function and presentation of the product.
Practically all regulations are quite clear as concerns the composition of a product by limiting or banning pharmacologically active, toxicologically relevant or downright poisonous substances in positive and negative ingredient lists. Unfortunately nowhere does the legislator define what exactly has to be understood by "pharmacological activity" or "toxicological relevance".
The mode and site of application is also quite clear; but the range of activity or function of a preparation is open to interpretation. For instance a product which has to be injected or implanted is nowhere considered as a legal cosmetic. But already products for oral application are interpreted differently in the Member States: e.g. chewing gums or (sugarless) "candies" for refreshing the breath or "beauty-from-within"-capsules (or any other galenical form) are classified in some countries as cosmetics, in other countries as food products.
Another example are products having antimicrobial properties. The cosmetic legislation does not define this expression. Is it just impeding (excessive) proliferation of germs ? Or must all microorganisms be killed or only a certain fraction ? In other words is an ”antimicrobial“ preparation microbistatic or microbicide or is a bactericide/fungicide still considered as a cosmetic product ?
When it comes to presentation (claims and advertising) of a product, legislators are at a loss: all countries ban, of course, claims referring to the prevention, alleviation or healing of diseases for cosmetics; but at present no definition is given of what is understood by the expression "disease"! It is also clearly understood that cosmetics are intended for (maintaining good condition) healthy and intact skin (hair, nails, teeth). But again no definition is given at what point skin is no longer intact or when a condition has to be named pathological. Would this for instance be the case when the skin itches? Or is an irritated skin no longer intact and already diseased ?
In general, direct references to the effectiveness of a preparation against diseases and illnesses are avoided in order to elude registration as a pharmaceutical. Nevertheless much creativity is spent on phrases and overall lay-out to suggest that a product has more than just "ordinary" cosmetic properties. In this way a grey area has emerged with numerous products whose classification is treated differently in the Member States due to different interpretations of the mentioned definitions.
In the following pages a catalogue has been compiled in order to demonstrate the different modes of delimitation between cosmetics and pharmaceuticals by the member states. The entries are samples and are by no means deemed to be comprehensive and complete. Having the inventiveness of the advertising people in mind this would be unachievable in any case.
The claims have been arranged for the whole range of cosmetic applications and split into two categories – Cosmetic claim and Non-cosmetic claim. In a 3rd column the national initials indicate the situation and classification in the corresponding Member State.
