for serious human rights violations

Cases of impunity for violations of human rights are unfortunately not uncommon, most often it concerns violations committed by police and prison officers, or violations directed against human rights defenders. Impunity erodes the rule of law and the full respect for human rights, as it tolerates offenses and thus encourages their repetition because the perpetrators and others feel free to commit further offenses, knowing they will be shielded from taking the responsibility.

Following an initiative of the Parliamentary Assembly - Recommendation 1876 (2009) on the state of human rights in Europe: the need to eradicate impunity - the Committee of Ministers invited the Steering Committee for Human Rights (CDDH) to study the feasibility of guidelines on impunity and to draft such guidelines.

The subordinate Committee of experts on impunity DH-I (terms of reference) was entrusted to carry out the work. The DH-I drew on inter alia the case-law of the European Court of Human Rights and on the work of the European Committee for the Prevention of Torture and Inhuman or Degrading Treatment or Punishment (CPT).

The Guidelines on eradicating impunity for serious human rights violations were adopted by the Committee of Ministers on 30 March 2011.
