decision on the merits
of the European Committee on Social Rights in the case «European
Roma and Travellers Forum (FERV) v. France », Complaint No. 64/2011,
became public on 4 June 2012.
In this case
ERTF alleged that the situation in France is not in conformity with Articles 16 (right of the family to social, legal and economic protection), 19§8 (guarantees concerning expulsion), 30 (right to protection against poverty and social exclusion) and 31 (right to housing) of the Revised European Social Charter, read alone or in conjunction with the non discrimination clause in Article E.
In its decision the European Committee of Social Rights
unanimously concluded:
- that there is a violation of Article E taken in conjunction with Article 19§8 concerning Roma of Romanian and Bulgarian origin;
- that there is a violation of Article E taken in conjunction with Article 30 concerning Travellers;
- that there is a violation of Article E taken in conjunction with Article 31§1 concerning Travellers and Roma of Romanian and Bulgarian origin;
- that there is a violation of Article E taken in conjunction with Article 31§2 concerning Travellers and Roma of Romanian and Bulgarian origin;
- that there is a violation of Article E taken in conjunction with Article 31§3 concerning persons choosing to live in caravans;
- that there is a violation of Article E taken in conjunction with Article 16. concerning the families of Travellers and the families of Roma of Romanian and Bulgarian origin.
